Tutela penal do embrião humano in vitro: uma releitura à luz da proteção jurídica das dimensões da vida

Resumo

O vertiginoso crescimento da engenharia genética, especialmente verificado após o surgimento e aprimoramento das técnicas de reprodução humana assistida, desvelou as bases genéticas da vida da espécie humana e acabou por expor a inequívocas situações sociais de risco um novo ente humano: o embrião in vitro, mantido em laboratório como excedente destas técnicas de fertilização artificial. Ainda que insolúvel a questão da existência de vida no embrião extrauterino, não se pode negar a ele o atributo da dignidade humana, porque ele é certamente portador do conjunto de genes que formam o patrimônio genético da humanidade, conferindo especial identidade genética à espécie. Como referidos riscos a este genoma se encontram aptos a lesionar ou colocar em perigo a própria vida da espécie humana, tomada em sua dimensão planetária, o Direito Penal, como subsistema do Ordenamento Jurídico, tem sido chamado a emprestar sua especial forma de tutela a novos bens jurídicos, com destaque para a identidade genética humana, configuradora de um novo direito fundamental de quarta geração: o direito ao genoma humano. Exsurge assim, nesse novo contexto social, a Biossegurança, entendida como o conjunto de ações que busca limitar, controlar ou neutralizar os riscos advindos da prática de diferentes tecnologias em laboratório ou no meio ambiente. Na esteira disso, é que a Lei de Biossegurança (Lei Federal nº 11.105/2005) vai dispor, nos arts. 24 a 26, sobre os crimes relacionados à proteção do genoma humano, que colocam em risco o bem jurídico-penal identidade da espécie humana
The vertiginous development of the genetic engineering, specially verified after the advent and improvement of the assisted human reproduction techniques, unveiled the genetic life basis of the human species and ended up into exposing unequivocal social risk situations of a new being: the embryo in vitro, kept in laboratory as artificial fertilization techniques remaining. Although insoluble, the life existence matter in an extra uterine embryo, it cannot be denied the human dignity attribute, because it is certainly the genes mass carrier that forms the mankind genetic heritage giving the species a special genetic identify. As noted, risks on this genome has been found able to injure or endanger the human life species itself, taken in its global dimension, the Penal Law, as a subsystem of de Legal System, has been invited to lend it special guardianship manner to the new legal assets, with emphasis for the human genetic identity, giving shape to a new fundamental fourth generation right: the new genome right. Then arises, on this new social context, the Bio security, perceived as the set of actions which seeks limiting, controlling or neutralizing the occurred risks of different technology practices in laboratories or in the environment. Consequently, the Bio Security Law (Lei Federal nº 11.105/2005) will provide, from articles 24 to 26, about crimes related to the human genome protection, that endangers the penal legal property human species identity
