dc.description.abstractA complexidade das relações familiares tem se relacionado intimamente ao Direito Societário, na medida em que se observa o aumento exponencial da utilização de sociedades empresárias de responsabilidade limitada no atual contexto brasileiro, refletindo na subsistência econômica das famílias. Assim, o presente trabalho buscou observar os reflexos patrimoniais decorrentes da correlação entre o Direito de Família e o Direito Societário, além da imprescindibilidade de formação de um complexo de bens e recursos capazes de sustentar e garantir segurança ao enlace afetivo para atender aos encargos familiares, principalmente quando ocorre um desequilíbrio econômico entre os sujeitos da relação. Sob tal aspecto, a pesquisa analisou a utilização de mecanismos empresariais, denominados como expedientes societários, usualmente utilizados para prejudicar a partilha da meação e permitir evasão dos bens comuns no momento da dissolução conjugal no âmbito do casamento e da união estável, em virtude da dissipação do afeto e das mágoas decorrentes do término, em contraposição à boa-fé nas relações jurídicas, sobretudo no âmbito familiar patrimonial, onde há deveres anexos de solidariedade e cooperação entre os entes familiares no ordenamento jurídico vigente. Dentro desse contexto de prejuízos à meação por meio da pessoa jurídica ou de pessoa física interposta no âmbito empresarial, buscou-se, com o uso do método dedutivo-bibliográfico, analisar as consequências patrimoniais e os mecanismos processuais e materiais de coibição hábeis à efetivação dos direitos fundamentais dos membros das famílias decorrente das considerações à observância da boa-fé nas referidas relações familiares patrimoniais. Os resultados do presente trabalho apontam que é salutar aos operadores do direito, em âmbito extrajudicial ou judicial, o conhecimento acerca dos reflexos recíprocos das questões familiares e empresariais para compreensão das peculiaridades da atividade empresarial para, desse modo, promover a efetivação dos direitos oriundos a famílias. Outrossim, os resultados demonstram a existência de instrumentos jurídicos processuais e materiais compatíveis com a coibição, preservação e recuperação dos bens que integram a meação.pt
dc.description.abstractThe complexity of family relationships has been closely related to Corporate Law, as we observe the exponential increase in the use of limited liability companies in the current Brazilian context, reflecting on the economic subsistence of families. Thus, the present work sought to observe the patrimonial reflexes resulting from the correction between Family Law and Corporate Law, in addition to the indispensability of forming a complex of goods and resources capable of sustaining and guaranteeing security to the affective bond to meet family responsibilities, especially when there is an economic imbalance between the subjects of the relationship. In this regard, the research analyzed the use of business mechanisms, known as corporate expedients, usually used to jeopardize the sharing of share and allow evasion of common goods at the time of marital dissolution within the scope of marriage and stable union due to the dissipation of the affection and sorrows arising from the termination, as opposed to good faith in legal relationships, especially in the family heritage context, where there are attached duties of solidarity and cooperation between family members in the current legal system. Within this context of damages to sharecropping through the legal entity or natural person interposed in the business scope, it was sought, using the deductive-bibliographic method, to analyze the patrimonial consequences and the procedural and material mechanisms of inhibition capable of the realization of fundamental rights of family members due to considerations regarding the observance of good faith in said family property relationships. The results of the present work point out that it is beneficial for legal practitioners, in an extrajudicial or judicial context, to have knowledge about the reciprocal effects of family and business issues in order to understand the peculiarities of business activity in order to, in this way, promote the realization of the rights arising from the families. Furthermore, the results demonstrate the existence of procedural and material legal instruments compatible with the restraint, preservation and recovery of the assets that make up the sharecropping.en
