Resumo
In this paper, we discuss the antidemocratic demonstrations that took place in late 2022 and the allegedly constitutional support based on article 142 of the Federal Constitution of 1988. We analyze the role assigned to the Armed Forces according to our legal system, discuss the processes of 1964 and 2016 that led to the downfall of presidents. Finally, we point out the need to broaden the debates on the memory of the military dictatorship as a way to prevent new institutional ruptures.
