Tutela estatal da internet à luz da técnica

Abstract

Este trabalho busca problematizar a responsabilidade dos Estados na proteção da internet, conciliando as críticas teóricas de Jacques Ellul sobre a técnica com casos práticos, mediante sua perspectiva de insuficiência técnico-jurídica na defesa dos direitos fundamentais no contexto da sociedade técnica hodierna. Assim, o problema central é estabelecer até que ponto deve o direito e o Estado ser eficaz, trazendo segurança ao cidadão-consumidor, em detrimento de sua liberdade – tão importante para Ellul – e privacidade, ou seja, estudar se existe algum limite, e qual é ele, à técnica informática que se impõe a custo da liberdade e da violação do direito à intimidade dos usuários. A conscientização da imponência do progresso técnico sobre a condição humana e das características intrínsecas da técnica devem ser alcançadas para a devida avaliação de seus efeitos na internet. Como método de abordagem, é utilizado o dedutivo. Utilizamos também o método dialético. E com o uso da lógica, costumes, bom senso e a moderação fático-lógica, deve-se alcançamos problematizações com a devida transparência, finalidade legítima e proporcionalidade. Foi concluído que o Direito tem que estar de acordo com a justiça e não deve enxergar o indivíduo dentro de uma racionalidade técnica.

This work seeks to problematize the responsibility of the States in relation to the protection of the internet, seeking to reconcile the theoretical criticisms of Jacques Ellul on the technique with practical cases, through his perspective of technique-legal insufficiency in the defense of fundamental rights in the context of the technical society today. Therefore, the main problem is to establish the extent to which the law and the State should be effective, bringing security to the citizen-consumer, to the detriment of their freedom – so important to Ellul – and privacy, that is, studying if there is any limit, and which is, to the technique that imposes itself at the cost of freedom and the violation of the users’ right to privacy. Awareness of the imposition of technique’s progress on the human condition and the intrinsic characteristics of the technique must be achieved in order to properly assess its effects in the internet. As a method of approach, the deductive method is used. We also use the dialectical method. And with the use of logic, customs, common sense and factual-logical moderation, we must reach problematizations with due transparency, legitimate purpose and proportionality. It was concluded that the Law has to be in accordance with justice and should not see the individual within a technical rationality.
