Resumo

O presente trabalho tem como escopo analisar a admissibilidade do Instituto do chamamento ao processo, previsto nos artigos 130 a 132 do Código de Processo Civil (CPC/2015), nas demandas em que se pleiteiam direitos fundamentais. A pesquisa se desenvolve no contexto do Ordenamento Jurídico brasileiro, à luz da doutrina e de casos concretos julgados pelo Superior Tribunal de Justiça (STJ), pelo Tribunal Superior do Trabalho (TST) e pelo Supremo Tribunal Federal (STF), e tem como objetivo a avaliação dos impactos negativos e positivos que o cabimento daquele Instituto processual pode causar à proteção e à efetividade dos direitos fundamentais. Visando-se ao objetivo proposto, inicialmente verificam-se, com base no CPC/2015 e na doutrina processualista civil, as principais características do chamamento ao processo, tais como: conceito, natureza jurídica, funções, procedimento e possibilidade formal da utilização do Instituto nas demandas em que se pede a tutela de direitos fundamentais. Após, investigam-se os posicionamentos do STJ, do TST e do STF sobre a admissibilidade do chamamento ao processo, traçados em julgamentos de casos nos quais se pleiteiam direitos fundamentais, a exemplo de pedidos atinentes a alimentos, direitos do idoso, direitos trabalhistas, proteção ao consumidor, proteção ao meio ambiente e saúde. Por fim, a partir do exame normativo, doutrinário e, principalmente, das interpretações daqueles tribunais superiores acerca da questão, extraídas de casos concretos por estes julgados, busca-se identificar e traçar parâmetros de ponderação para a admissibilidade do chamamento ao processo nas demandas que versam sobre direitos fundamentais, para que o manejo dessa modalidade de intervenção de terceiros seja adequado à efetiva tutela dos direitos fundamentais materiais.
The purpose of this paper is to analyze the admissibility of the institute of the joinder of codebtor, provided for in articles 130 to 132 of the Brazilian Code of Civil Procedure (CPC/2015), in the claims in which fundamental rights are claimed. The research is developed in the context of the Brazilian Legal System, in the light of doctrine and concrete cases judged by the Superior Court of Justice (STJ), the Superior Labor Court (TST) and the Federal Supreme Court (STF), and its objective is to evaluate the negative and positive impacts that the admissibility of that procedural institute can have on the protection and effectiveness of fundamental rights. Aiming at the proposed objective, initially, based on CPC/2015 and the civil proceduralist doctrine, the main characteristics of the joinder of codebtor, such as: concept, legal nature, functions, procedure and formal possibility of using the institute in the demands for the protection of fundamental rights. After that, the STJ, TST and STF's positions on the admissibility of the joinder of codebtor are investigated, traced in judgments of cases in which fundamental rights are claimed, such as support obligations, the rights of the elderly, labor rights, consumer protection, environmental protection and health. Finally, from the normative, doctrinal examination and, mainly, from the interpretations of those superior courts about the question, extracted from concrete cases judged by them, we seek to identify and set weighting parameters for the admissibility of the joinder of codebtor to the lawsuits that fundamental rights, so that the management of this type of third party intervention is adequate to the effective protection of material fundamental rights.
