Resumo

Based on a provisional survey conducted by the National Justice Council (CNJ) at the beginning of 2017, it has been established that Brazil has more than six hundred thousand prisoners inserted in the chaotic prison system and, among the several individuals incarcerated, physical, hearing or visual impairment. Taking as a methodological basis the analysis of specialized bibliography and documents from national public agencies, the objective of this work is to analyze the accessibility conditions presented to people with disabilities who are inserted in the Brazilian prison environment, examining, from the legal point of view and guaranteeing the rights of vulnerable groups, the conditions that the State imposes on them for the execution of the custodial sentence. Among the results found, it is verified that the person with disabilities has limitations regarding the exercise of their fundamental rights of first and second dimensions, since there are no architectural or attitudinal adaptations to receive them in national prisons, which encourages a material inequality between those who are disabled and others who are not.
