Para tanto, foi realizado um estudo da jurisprudência do TJ do Rio de Janeiro para verificar como o judiciário influencia na realização das políticas públicas de saneamento básico. O estudo para alcançar esse objetivo foi feita a partir da pesquisa exploratória dos julgados do TJ do Rio de Janeiro para que fosse realizada uma jurimetria a partir de uma abordagem quantitativa e qualitativa dos dados coletados. A partir desta análise, percebeu-se que em muitos acórdãos o judiciário não leva em consideração se há ou não um planejamento delimitado pela Administração Pública para que haja decisão sobre a realização ou não de obras de saneamento básico. Com isso, pode-se perceber que o presente trabalho contribui para futuros estudos no sentido de materializar, de fato, o direito ao saneamento básico.The following paperwork was inspired by the need to understand the influence of the Judiciary, more specifically the influence of the Tribunal de Justiça in Rio de Janeiro, over the materialization of the social right to basic sanitation from the law 11.445/2007. Therefore, a study of the jurisprudence from the TJ of Rio was made to verify the influence of the judiciary over the realization of basic sanitation public policy. The research to find this result was made in a exploratory way, analyzing the jurisprudence from the TJRJ to do a jurimetry and then do a qualitative and quantitative analysis of the data collected. From this analysis this research could notice that the judiciary doesn’t take into consideration if there is or if there is not a planning guide given by the public administration when offering the decision that regards about the construction of basic sanitation work.
