For this purpose, both the proposition of opening in constitutional hermeneutics, summarized in the concept of an open society of interpreters from Peter Häberle, and the conception of controlling the Political Sphere from the Public Sphere, in Habermas, will be used as theoretical framework reinterpreted under the optics of Participative Institutions.Resumo O presente trabalho tem como objetivo aplicar os pressupostos da teoria crítica da democracia e as suas implicações à hermenêutica constitucional para atualizar o debate sobre a divisão dos poderes entre circuito governo-parlamento e jurisdição constitucional, com a inserção das Instituições Participativas (IPs) como elemento de controle no caso brasileiro.
