Resumo
O presente trabalho buscou retomar a transformação da sociedade brasileira na passagem do Império para a Primeira República. Partindo da existência jurídica das populações de matriz indígena e africana, foram remontados quadros da sociedade brasileira até o declínio do infame instituto da escravidão. Neste estudo de sociologia histórica, artefatos da cultura legal, e do Direito Penal em particular, tiveram locus privilegiado de análise, possibilitando realizar um mapeamento da organização judiciária do Império à aurora republicana. Esta dissertação se orientou a reconstituir a realidade histórica brasileira, não pura e simplesmente pelos artefatos da cultura legal expressos pelo poder central, mas, antes e sobretudo, pelo complexo punitivo que, além de causar dor no fazer viver das classes dominadas, conforma comportamentos que positivam a inadaptação dos abandonados, daqueles que foram e ainda são os feridos da herança escravista. Assim,este trabalho, como um todo orgânico, buscou compreender e evidenciar o passado do Brasil tematizando a penalidade cotidiana pelo método da arqueogenealogia.
The present work seeks to resume the transformation of Brazilian society during the transition from the Empire to the First Republic. Starting from the legal existence of the indigenous and african populations, frame of Brazilian society were retraced until the decline of the infamous slavery institute. In this study of historical sociology, the artifacts of legal culture, and of Criminal Law in particular, had a privileged locus of analysis, making it possible to map the judicial organization from the Empire to the dawn of the Republic. This dissertation was oriented to reconstitute the Brazilian historical reality, not purely and simply by the artifacts of the legal culture expressed by the central power, but before and above all, by the punitive complex, that besides causing pain inthe making of life of the dominated classes, conforms behaviors that posit the inadaptation of the abandoned, of those who were and still are wounded by the slavery heritage. Thus, this work, as an organic whole, seeks to understand and to make evident Brazil's past by thematizing everyday penalty using the archogenealogical method.
