Resumo

O Estado de Direito impõe o reforço da garantia dos direitos individuais de modo que o primado da liberdade pessoal assume elementar proteção a ponto de a sua privação consistir em forma de sanção jurídica dependente de estrita observância de requisitos legais. Nesse sentido, o instituto da responsabilidade civil do Estado evoluiu com vistas à crescente proteção do indivíduo e limitação da atuação estatal, de modo a se consagrar, a partir da Constituição da República de 1988, a responsabilidade objetiva do Estado sob a teoria do risco administrativo. Objetiva-se com o presente trabalho, então, elucidar a questão atinente à responsabilização estatal em face de privação do indivíduo que se mostrou ilegal, enquanto manifestação do chamado mau funcionamento da prestação jurisdicional ou erro judiciário, conforme art. 5º, LXXV, da Carta Magna. Evidencia-se, através de minucioso estudo bibliográfico, normativo e jurisprudencial, sob o método lógico-indutivo, que o fundamento da responsabilidade estatal em caso de prisão ilegal reside no risco assumido pela utilização desse método de sanção como forma de proteção da coletividade e bem-estar social. A indenização conferida nesses casos está associada à afronta à dignidade da pessoa humana, atrelada à responsabilidade civil do Estado pelo erro judiciário. No tocante à prisão cautelar que se mostrou indevida, contudo, objeto de maior complexidade, o presente estudo contribuiu para esclarecer o posicionamento que vem sendo adotado no sentido de que a ilegalidade da prisão provisória não se revela pela posterior sentença absolutória, mas sim pelas circunstâncias de sua decretação, exigindo-se estrito cumprimento dos requisitos legais e fundamentação adequada. Conclui-se, através desta monografia, que o primado da liberdade pessoal impõe rigorosa proteção ao indivíduo, o qual dispõe de direito fundamental à reparação de danos pelo Estado nos casos em que se configura a prisão ilegal.
The rule of law imposes the strengthening of the guarantee of individual rights so that the primacy of personal freedom assumes elementary protection to the point that its deprivation consists in a form of legal sanction dependent on strict compliance with legal requirements. In this sense, the institute of civil liability of the State evolved aiming the increasing protection of the individual and the limitation of state action, in order to consecrate, from the Constitution of the Republic of 1988, the objective liability of the State under the theory of administrative risk. The objective of the present paper, then, is to elucidate the question concerning the State's liability in face of the deprivation of the individual that was shown to be illegal, as a manifestation of the so-called malfunctioning of the jurisdictional provision or judicial error, according to art. 5, LXXV, of the Constitution. It is evident, through a thorough bibliographic, normative and jurisprudential study, under the logical-inductive method, that the foundation of state responsibility in case of illegal imprisonment lies in the risk assumed by the use of this method of sanction as a way of protecting the community and social welfare. The compensation awarded in these cases is associated with the affront to human dignity, linked to the State's civil responsibility for judicial error. Regarding the remand in custody that proved to be undue, however, object of greater complexity, this study helped to clarify the position that has been adopted in the sense that the illegality of the provisional arrest is not revealed by the subsequent sentence of acquittal, but by the circumstances of its decree, requiring strict compliance with legal requirements and adequate grounds. It is concluded, through this monograph, that the primacy of personal freedom imposes strict protection of the individual, which has a fundamental right to compensation for damages by the State in cases where it configures the illegal arrest.
