Resumo
O contrato especial de trabalho desportivo reúne características tradicionais das relações comuns de emprego, com especificidades do direito do desporto, resultando em vínculo trabalhista singular. Nesse contrato, institutos e preceitos fundantes do direito do trabalho assumirão formas distintas e contornos peculiares, a fim de se adequar à realidade específica do labor desportivo, e tutelar as figuras nele envolvidas de forma adequada. Tomarão parte nesse contrato: a entidade de prática desportiva, na figura do empregador, e o atleta, na posição de empregado. Tal dicotomia é a base dessa relação e das discussões que lhe afloram, havendo especificidades que permearão tal vínculo do momento que se constitui até sua extinção. Nesse contexto, o trabalho se orienta a abordar tal relação contratual sob uma perspectiva temporal, passando-se pelos momentos cruciais do início de sua vigência, atingindo-se as circunstâncias em que sua exigibilidade será sustada e debruçando-se sobre sua extinção. Acerca do início de sua vigência, se estudará os principais requisitos e fundamentos relacionados à celebração de tal pacto, definindo-se os sujeitos, prazos, forma e outras questões como a pactuação da remuneração e as obrigações impostas às partes. Nas hipóteses de sustação desse contrato de trabalho, deve-se estabelecer as distinções básicas entre interrupção e suspensão do contrato, abordando-se as principais hipóteses de sua configuração, bem como pontuando as situações típicas atinentes à relação desportiva. Por fim, no que tange à extinção desse contrato, a lei especial desportiva enumera as possibilidades de dissolução contratual desse vínculo, tendo sempre a norma trabalhista como fonte subsidiária.
The special sports labor contract gathers traditional characteristics of the common employment relations with specificities of the sports law, resulting in a unique labor relation. In this contract, major institutes and precepts of labor law will assume distinct forms and peculiar contours, in order to adapt to the specific reality of the sports labor, and protect the parties involved on it in an adequate manner. The sports practice entity, as the employer, and the athlete, as the employee, will take part in this contract. This dichotomy is the basis of this relation and of the discussions that arise from it, and there are specificities that will permeate this bond from the moment it is constituted until its termination. In this context, the work is oriented to approach this contractual relationship under a temporal perspective, going through the crucial moments of the beginning of its effectiveness, reaching the circumstances in which its enforceability will be sustained and focusing on its termination. About the beginning of its effectiveness, the main requirements and fundamentals related to the execution of such a pact will be studied, defining the subjects, terms, form and other issues such as the agreement on the remuneration and the obligations imposed on the parties. In the cases of suspension of this employment contract, the basic distinctions between interruption and suspension of the contract must be established, addressing the main hypotheses of its configuration, as well as pointing out the typical situations pertaining to the sports relationship. Finally, about the termination of this contract, the special sports law enumerates the possibilities of contractual dissolution of this bond, always having the labor rules as a subsidiary source.
