A sojicultura brasileira e a sustentabilidade ambiental: reflexões sobre a legislação nacional e a Moratória da Soja

Resumo

A agroexportação brasileira possui extrema relevância para a economia nacional, tendo o complexo soja como seu principal produto. No país, a produção começou a crescer desde 1970, sendo que a partir de 1990 se expandiu constantemente, avançando da região Sul para o Centro-Oeste, Norte e Nordeste nas últimas décadas. Dessa forma, tendo em vista que a sojicultura adentrou áreas que abrigam importantes biomas brasileiros, dentre os quais, a Amazônia, é preciso entender como o setor vem se adequando à proteção ao meio ambiente exigida, não só internamente, mas também pela comunidade internacional, que desde o século passado vem endereçando cada vez mais a questão, a partir de uma análise da proteção ambiental legal, com base no amplo e inovador tratamento constitucional da matéria, e da regulação do mercado importador, por meio de instrumentos voluntários de governança sustentável, com foco no pacto setorial da Moratória da Soja. Diante disso, objetiva-se estudar a legislação nacional aplicável ao cultivo de soja no bioma amazônico e a Moratória da Soja e compreender qual é a relação entre ambos os mecanismos, bem como analisar suas aptidões de garantir uma sojicultura sustentável, diante das restrições cada vez mais impostas pela União Europeia, segunda maior importadora da soja brasileira; da real possibilidade de eventuais exigências do mercado chinês, maior importador da soja brasileira; do aumento das taxas de desmatamento na Amazônia desde 2012; e da relevância do cenário político para a matéria. O presente trabalho tem finalidade básica pura e é exploratório e explicativo, tendo sido desenvolvido a partir de pesquisa bibliográfica, documental e legislativa, ressaltando-se a mínima presença do tema na literatura jurídica acadêmica. No primeiro capítulo, tem-se uma apresentação da proteção ambiental nos cenários internacional e nacional e a análise da relação entre o avanço da sojicultura e a degradação da Amazônia. No segundo capítulo, aborda-se a legislação nacional principal de proteção às vegetações nativas de forma crítica e, no terceiro capítulo, é estudado o instrumento de governança ambiental da Moratória da Soja, com a posterior análise de sua relação com a lei, levando em consideração aspectos políticos, sociais e econômicos. Concluiu-se, por fim, que há mútuo reforço entre os mecanismos de promoção do desenvolvimento sustentável da sojicultura, os quais, apesar de possuírem falhas e questões passíveis de críticas, são aptos, se aprimorados e explorada a sua relação, a contribuir ainda mais para a proteção ambiental no setor, sendo imprescindível, para isso, respaldo e apoio político.
Brazilian agro-export is extremely relevant for the national economy, the soy complex being its main product. The production's begun to increase since 1970, and from 1990 onwards it has expanded constantly, advancing from the South to the Midwest, North and Northeast in recent decades. Thus, considering soy farming has entered areas where important Brazilian biomes are, including the Amazon, it’s necessary to understand how the sector has been adapting to the environmental protection required not only internally, but also by the international community, which, since the last century, has increasingly addressed the issue, based on an analysis of legal environmental protection, from the vast and innovative constitutional treatment of the matter, and the regulation of the import market, through voluntary instruments of sustainable governance, focusing on sectorial pact Soy Moratorium. Therefore, the objective is to study the national legislation applicable to the cultivation of soy in the Amazon biome and the Soy Moratorium and to understand the relationship between the two mechanisms, as well as to analyze their abilities to promote a sustainable soy industry, given the increasingly restrictions imposed by the European Union, the second largest importer of Brazilian soybeans; the real possibility of new environment restrictions from the Chinese market, the largest importer of Brazilian soybeans; the increase in deforestation rates in the Amazon since 2012; and the political scenario relevance for the matter. The present work has a pure, exploratory and explanatory basics and was developed from bibliographical, documental and legislative research, recoiling the minimal presence of the theme in academic law literature. In the first chapter, there’s a presentation of environmental protection in the international and national scenarios and an analysis of the relationship between the advance of soy farming and the degradation of the Amazon. In the second chapter, the main national legislation for the protection of native vegetation is critically addressed and, in the third chapter, the environmental governance instrument Soy Moratorium is studied, with a subsequent analysis of its relationship with the law, leading to political, social and economic aspects. Finally, it was concluded that there is a mutual reinforcement between the mechanisms for promoting the sustainable development of soy farming, which, despite the flaws and objectionable points, are suitable, if improved and their relationship explored, and can contribute even more for environmental protection in the sector, but first, political support is essential.
