Resumo
Considerando a iminência de escassez de insumos hospitalares em virtude da ascensão da
pandemia do novo coronavírus, examinam-se os reflexos jurídicos da requisição administrativa
de bens hospitalares perante a repartição constitucional de competências entre os entes da
federação em tempos de COVID-19 no Brasil, cujo propósito é estudar o vínculo entre a
aplicação do ato administrativo e as relações interfederativas. Com esse intuito, é
imprescindível descrever as características vitais da requisição administrativa e dos institutos
relacionados, identificar as mais relevantes propriedades da repartição constitucional de
competências na federação, e avaliar os conflitos federativos envolvendo a requisição
administrativa no Brasil acerca do impasse de bens médicos no combate à pandemia do
coronavírus. Dessarte, desempenha-se a metodologia via pesquisa hipotético-dedutiva,
descritiva e qualitativa a partir de dados bibliográficos e documentais. Assim sendo, elucidam-se os traços da requisição administrativa, explicam-se as especificidades da distribuição de
competências e pondera-se acerca do impacto do ato administrativo diante da relação
interfederativa, comprovando que a requisição administrativa tem aplicação restrita à
propriedade privada, ressalvados os contextos de Estado de Defesa e Estado de Sítio, de modo
que o emprego do instituto entre os entes fere o pacto federativo e a autonomia dos gestores
públicos.
Considering the imminence of a shortage of hospital supplies due to the rise of the new coronavirus pandemic, the legal consequences of the administrative requisition of hospital goods are examined in view of the constitutional division of competences between the entities of the federation in times of COVID-19 in Brazil, whose purpose is to study the link between the application of the administrative act and inter-federative relations. To this end, it is essential to describe the vital characteristics of the administrative requisition and related institutes, to identify the most relevant properties of the constitutional division of competences in the federation, and to evaluate the federative conflicts involving the administrative requisition in Brazil regarding the impasse of medical goods in the fight to the coronavirus pandemic. Thus, the methodology is carried out via hypothetical-deductive, descriptive and qualitative research based on bibliographic and documentary data. Therefore, the features of the administrative requisition are elucidated, the specificities of the distribution of competences are explained and the impact of the administrative act on the interfederative relationship is pondered, proving that the administrative requisition has application restricted to private property, except for the State of Defense and State of Siege contexts, so that the use of the institute among the entities hurts the federative pact and the autonomy of public managers.
