dc.description.abstractO Poder Judiciário brasileiro passou por um intenso processo de concretização de sua independência e autonomia após a Constituição de 1988. Com o crescimento de seu protagonismo diante do cenário político nacional, não tardaram a surgir movimentos pela Reforma do Judiciário, a fim de que se pudesse deixa-lo mais transparente e controlável. Assim, com a Emenda Constitucional n. 45 de 2004, inúmeras inovações foram instituídas dentro da estrutura judiciária e, dentre elas, criou-se o Conselho Nacional de Justiça (CNJ), como órgão de cúpula administrativa do Judiciário. O CNJ tornou-se responsável por controlar administrativamente todo o Judiciário, a fim de que a sociedade pudesse enxergar nele a confiança e legitimidade necessárias. E é neste contexto que surge a questão da accountability. A accountability judiciária, entendida como uma prestação de contas seguida de uma responsabilização, poderia ser realizada pelo CNJ? Estaria ele apto, dentro de suas competências constitucionais e regimentais, a controlar e fiscalizar os atos administrativos do Judiciário? E mais, como o Judiciário não é um poder composto por membros democraticamente eleitos pelo povo, poderiam os cidadãos auxiliar o CNJ na tarefa de accountabilizar o Judiciário? Sendo assim, o presente trabalho terá o condão de analisar a questão do surgimento do fenômeno da accountability dentro do Judiciário, explicitar as modalidades existentes, analisar as atribuições constitucionais e regimentais do CNJ, realizar um estudo comparado entre conselhos de justiça pelo mundo, e por fim, pretender-se-á demonstrar se o CNJ poderá ser o destinatário dessa accountability judiciária, bem como suas hipóteses de instrumentalização e se os cidadãos também podem auxilia-lo nesta tarefa em busca por uma jurisdição mais cidadã.pt
dc.description.abstractThe Brazilian Judicial Branch went through an intense process of materializing its independence and autonomy after the Constitution of 1988. With the growth of its protagonism in the national political scene, movements for the Judicial Reform soon appeared, so that it could be possible makes it more transparent and controllable. Thus, with Constitucional Amendment n. 45 of 2004, innumerable innovations were instituted with the judicial structure and, among them, the National Council of Justice was created, as the administrative dome organ of Judicial Branch. The National Council has became the responsible for administratively controlling of the entire Judiciary, so that society could seen the judicial trust and legitimacy. And it is in this context that the question of accountability arises. Could judicial accountability, understood as accountability followed by responsibility for acts, be carried out by the National Council? Would he be able, within his constitutional and regimental powers, to control and inspect judicial acts? Furthermore, since the Judiciary is not an organism composed of members democratically elected by the population, could citizens assist the National Council in the task of making the Judiciary accountable? Therefore, the present work will be able to analyze the question of the emergence of the phenomenon of accountability within the Judiciary, explain the existing modalities, analyze the constitutional and regimental attributions of the Council, carry out a comparative study between councils of justice around the world, and by finally, it will be intended to demonstrate whether the National Council can be the recipient of this judiciary accountability, what its chances of being instrumentalized and whether citizens can also assist it in this taks for a more citizen jurisdiction.en
