As uniões poliafetivas: sua realidade como nova forma familiar e a importância da atividade extrajudicial para efetivação do instituto e da cidadania participativa

Resumo
A presente dissertação tem por objetivo demonstrar o impacto e a necessidade da atividade extrajudicial para a consolidação das políticas públicas e dos direitos fundamentais que resul-tam na efetividade das distintas formas de família da sociedade contemporânea, sua estrutura e sua aplicação, notadamente no que tange as uniões poliafetivas. O instituto familiar, anteri-ormente analisado apenas sob a ótica patrimonial, corroborando-se a uma realidade de socie-dade patriarcal, passou ao aprimoramento de suas perspectivas através da base principiológica da afetividade. Dessa forma, temos que interpretar o Código Civil à luz da Constituição Fede-ral sendo necessário reconhecer verdadeiro pluralismo de entidades familiares, devendo o ordenamento jurídico garantir-lhes respeito e proteção. A repersonalização das relações fami-liares, possibilitada pelo reconhecimento do valor jurídico e social do afeto como o fator rele-vante para a composição familiar promoveu uma releitura do instituto da família que passou a ser guiado pelos princípios e regras constitucionais, objetivando o desenvolvimento da perso-nalidade e a efetivação da dignidade de todos os integrantes da família. O problema norteador do trabalho decorre das lacunas do ordenamento jurídico que dificultam o exercício do direito à poliafetividade, sendo que o objetivo nuclear deste é demonstrar a necessidade da urgente revisão dos modelos jurídicos atuais. Diante das diferentes situações familiares, a atividade extrajudicial se apresenta como elemento de acesso do cidadão aos ditames contemporâneos que norteiam tal instituto e suas variações. A entidade familiar é a manifestação de vontade de constituir família, e levaremos sempre em consideração que o conceito de família atual é afe-tivo. Assim, o Poliamor ou Relação Poliafetiva, união afetiva entre mais de duas pessoas, é assunto polêmico decorrente da perspectiva familiar atual e que merece ser visto sob o manto constitucional dos Direitos Sociais atrelados a dimensão simbólica das políticas públicas. The purpose of this dissertation is to demonstrate the impact and necessity of extrajudicial activity for the consolidation of public policies and fundamental rights that result in the effec-tiveness of the different forms of family in contemporary society, its structure and its applica-tion, the polyphase unions. The family institute, previously analyzed only from the patrimonial perspective, corroborated to a reality of patriarchal society, went to the improvement of its perspectives through the principiológica base of affectivity. In this way, we have to interpret the Civil Code in the light of the Federal Constitution and it is necessary to recognize true pluralism of family entities, and the legal system must guarantee them respect and protection. The repersonalization of family relations, made possible by the recognition of the juridical and social value of affection as the relevant factor for the family composition, promoted a re-reading of the family institute that began to be guided by constitutional principles and rules, aiming the development of dignity of all members of the family. The guiding problem of the work stems from the shortcomings of the legal system that make it difficult to exercise the right to poliafetividade, and its core objective is to demonstrate the urgent need to review current legal models. In the face of different family situations, extrajudicial activity is presented as an element of citizen access to the contemporary dictates that guide this institute and its variations. The family entity is the manifestation of the will to constitute a family, and we will always bear in mind that the concept of the present family is affective. Thus, the Poliamor or Poliaffective Relation, affective union between more than two people, is controversial subject from the current familiar perspective and that deserves to be seen under the constitutional mantle of the Social Rights tied to the symbolic dimension of the public policies.
