Saindo das sombras: Atuação estratégica da Defensoria Pública de São Paulo e a Política Mães em Cárcere

Resumo
Uma das principais angústias das mães presas diz respeito à falta de acesso à justiça, para garantir seus direitos à convivência familiar e à liberdade. Considerando que é papel da Defensoria Pública garantir assistência jurídica integral às pessoas mais vulneráveis, essa pesquisa objetivou entender como a Defensoria de São Paulo se organizou para atender às necessidades jurídicas das mães presas no estado. Para tanto, nos valemos do método de Estudo de Caso, sob uma perspectiva prevalentemente indutiva, através de entrevistas, observações diretas e análise de documentos. A Defensoria Paulista se organizou através da Política Mães em Cárcere para prestar assistência jurídica às mães presas. A Política foi estabelecida em 2014, através da deliberação CSDP 291/14, fruto da mobilização de movimentos sociais, especialmente a Pastoral Carcerária. Para a garantia dos diferentes direitos das mães presas, foi definida formas diferenciadas para acessar a Política, como formulários específicos; diversos núcleos especializados da Defensoria se articularam para enfrentar as diferentes demandas jurídicas que as mães presas possuem e são mobilizados outros saberes além do jurídico para a garantia da assistência jurídica integral. O Mães em Cárcere proporciona, ainda, meios para que as usuárias da instituição falem sobre suas histórias e dificuldades. Os resultados da Política são sistematizados em relatórios anuais e discutidos em audiência pública, quando há a possibilidade de avaliação das ações da Defensoria Pública e participação popular na definição dos passos futuros da Política.
One of the main anxieties of imprisoned mothers concerns the lack of access to justice, to guarantee their rights to family life and freedom. Considering that it is the role of the Public Defender's Office to guarantee comprehensive legal assistance to the most vulnerable people, this research aimed to understand how the São Paulo Public Defender's Office was organized to meet the legal needs of imprisoned mothers in the state. Therefore, we used the Case Study method, under a predominantly inductive perspective, through interviews, direct observations and document analysis. São Paulo Public Defender's Office organized itself through the Policy Mothers in Prison to provide legal assistance to imprisoned mothers. The Policy was established in 2014, through the CSDP deliberation 291/14, the result of the mobilization of social movements, especially the Pastoral Carcerária. To guarantee the different rights of imprisoned mothers, different ways to access the Policy were defined, such as specific forms; several specialized nuclei of the Defender's Office have articulated to face the different legal demands that incarcerated mothers have and other knowledge are mobilized in addition to legal knowledge to guarantee comprehensive legal assistance. Mothers in Jail also provides means for the institution's users to talk about their stories and difficulties. The results of the Policy are systematized in annual reports and discussed at a public audiences, when there is the possibility of evaluating the actions of the Public Defender's Office and popular participation in defining the Politic’s future steps.
