Estereótipos de gênero no Sistema Internacional de Proteção dos Direitos Humanos

Abstract

Gender stereotypes - although some variations may occur due to their intersectionality with, mainly, race, class and sexual orientation - are responsible for the creation and perpetuation of systemic beliefs that justify the subordination of women in society. The bodies of the International System for the Protection of Human Rights, in addition to playing a central role in combating and preventing gender-based violence, are not immune to the reproduction of gender stereotypes. This stereotyping is an obstacle to the realization of women's human rights – especially with regard to access to justice. The present work is a bibliographical and jurisprudential research on what gender stereotypes are, how to identify them, their impacts on the way the feminine is perceived and how it appears in the law and in the decisions of international bodies. It is divided into three parts: (a) the first part will address the idea of stereotype and specifically the gender stereotype; (b) in a second moment, we will understand the laws, conventions and treaties, especially those that aim to eliminate a stereotyped view of the feminine and masculine; (c) later we will look into the jurisprudence of the International System for the Protection of Human Rights.

Os estereótipos de gênero - apesar de variarem em razão da interseccionalidade com, principalmente, raça, classe e orientação sexual - são responsáveis pela criação e perpetuação de crenças sistêmicas que justificam a subordinação da mulher na sociedade. Os órgãos do Sistema Internacional de Proteção dos Direitos Humanos, a par de exercerem papel central no combate e prevenção à violência de gênero, não estão imunes à reprodução dos estereótipos de gênero. Esta estereotipagem é, além de uma violência institucional, um obstáculo para concretização dos direitos humanos de mulheres – mormente no que tange ao acesso à justiça. O presente trabalho é uma pesquisa bibliográfica e jurisprudencial sobre o que são os estereótipos de gênero, como identificá-los, os seus impactos na forma como o feminino é percebido e como ele aparece na lei e nas decisões dos órgãos internacionais. Está dividido em três partes: (a) a primeira parte abordará a ideia de estereótipo e especificamente o estereótipo de gênero; (b) em um segundo momento, trataremos das legislações, convenções e tratados que versam sobre o tema, especialmente aqueles que objetivam a eliminação de uma visão estereotipada do feminino e masculino; (c) posteriormente nos debruçaremos sobre a jurisprudência do Sistema Internacional de Proteção dos Direitos Humanos.
