Sucessão Legítima na União Estável: avanços e desafios

Abstract

O presente trabalho tem o intuito de estudar os avanços e desafios na sucessão legítima do companheiro sobrevivente na união estável, abrangendo sua evolução histórica e principais adversidades sobre o tema. A pesquisa seguirá o método de abordagem bibliográfica dedutiva, através da análise da legislação e da doutrina, buscando, ainda, entender quais as prováveis implicações do direito sucessório. Apresentará noções gerais sobre o direito de família contemporâneo, de modo a compreender seus princípios basilares, além de aclarar conceitos a respeito da união estável, quanto à terminologia e seus elementos constitutivos, diferenciando-a do casamento e institutos afins. Outrossim, busca examinar a sucessão legítima, a vocação hereditária e os efeitos sucessórios entre os companheiros, decorrentes da existência de uma união estável antes e após o julgamento do Recurso Extraordinário nº 878.694, onde o STF reconheceu e declarou a inconstitucionalidade do artigo 1.790 do Código Civil de 2002, equiparando a união estável com o casamento no que concerne aos direitos sucessórios. Ademais, será analisada a omissão do STF em declarar se o companheiro(a) sobrevivente passa a ser incluído no rol de herdeiros necessários e sobre a manutenção do direito real de habitação em seu favor. Dessa forma, o objetivo geral será o de analisar os efeitos sucessórios entre os companheiros, decorrentes da existência de uma união estável, momento em que serão observados os principais desafios, avanços e retrocessos que envolvem o instituto.

The present work aims to study the advances and challenges in the legitimate succession of the surviving partner in the common-law marriage, approaching its historical evolution and main adversities on the subject. The research will follow the method of deductive bibliographic approach, through the analysis of legislation and doctrine, also looking up to understand the probable implications of inheritance rights. The work will present general notions about contemporary family law, in order to understand its basic principles, in addition to clarifying concepts about common-law marriage, as to the terminology and its constituent elements, differentiating it from marriage and related institutes. Furthermore, this work aims to examine the legitimate succession, the hereditary vocation and the succession effects between partners, arising from the existence of a common-law marriage before and after the judgment of Extraordinary Appeal No. 878,694, in which the SCJ recognized and declared the unconstitutionality of article 1.790 of the Civil Code of 2002, equating the common-law marriage with marriage with regard to inheritance rights. Furthermore, the SCJ's omission about whether the surviving partner will be included in the list of necessary heirs and the maintenance of the real housing right in their favor, will be analyzed. Thus, the general goal will be to analyze the succession effects between the partners, resulting from the existence of a common-law marriage, at which time the main challenges, advances and setbacks involving the institute will be observed.
