(Im) possibilidade e limites jurídicos e constitucionais do trabalho infantil artístico.

Abstract

Apresenta-se, neste trabalho, uma análise crítica acerca das condições em que se dá o trabalho de crianças e adolescentes no meio artístico atual, considerando o ingresso, cada vez mais frequente, destes sujeitos no “mundo adulto”, repleto de riscos, muitas vezes despercebidos ou ignorados por aqueles que teriam a prerrogativa de protegê-los. Assim, o objetivo do presente estudo é analisar o trabalho infantil no meio artístico no espectro atual, considerando também a nova era digital, bem como sua conformidade com o ordenamento jurídico no tocante à proteção dos direitos e garantias das crianças. Aborda-se, portanto, a origem do trabalho infantil e sua evolução, até a conquista social da sua proibição e combate, por meio da luta pela proteção dos direitos da criança e do adolescente, com base na Constituição de 1988, na CLT, no ECA e nas Convenções da OIT; os aspectos jurídicos que envolvem a infância e a atividade laboral nesta fase, com enfoque no prisma do trabalho exercido por esses jovens no setor artístico, frente ao embate entre liberdade de expressão e desenvolvimento da arte versus proteção integral e garantia de direitos fundamentais; os principais atores responsáveis por garantir e proteger os direitos e deveres desses sujeitos, os agentes estatais e a base familiar; e a atuação do Poder Judiciário e do Ministério Público, enquanto garantidores desses direitos, diante do previsto no arcabouço jurídico vigente. Para tanto, adota-se, como método de procedimento, o levantamento por meio da técnica de pesquisa bibliográfica em materiais publicados; e, como método de abordagem, o dedutivo, visando, a partir da análise do trabalho infantil artístico e do seu contexto, bem como do ordenamento jurídico pátrio, extrair conclusões referentes à suficiência do ordenamento jurídico pátrio para tutelas os direitos dessas crianças e à atuação do Poder Judiciário e do Ministério Público do Trabalho para o equilíbrio entre o trabalho artístico infantil e a proteção dos direitos da criança nesse contexto. Como conclusão, observa-se encontrar-se defasada a regulamentação acerca do trabalho artístico de crianças e adolescentes, com diversas lacunas legislativas capazes de gerar insegurança jurídica, dificultando, assim, o seu controle e a sua fiscalização.

This paper presents a critical analysis of the conditions under which children and adolescents work in the current artistic environment, considering the increasingly frequent entry of these subjects into the "adult world", full of risks that are often unnoticed or ignored by those who have the prerogative of protecting them. Thus, the objective of this study is to analyze child labor in the artistic environment in the current spectrum, considering also the new digital age, as well as its conformity with the legal system with regard to the protection of children's rights and guarantees. Therefore, the origin of child labor and its evolution is approached, until the social conquest of its prohibition and combat, through the fight for the protection of the rights of children and adolescents, based on the 1988 Constitution, on the CLT, on the ECA and on the ILO Conventions; the legal aspects involving childhood and the labor activity in this phase, focusing on the prism of the work performed by these young people in the artistic sector, facing the clash between freedom of expression and the development of art versus full protection and guarantee of fundamental rights; the main actors responsible for guaranteeing and protecting the rights and duties of these subjects, the state agents and the family base; and the performance of the Judiciary and the Public Prosecutor's Office, as guarantors of these rights, in view of what is foreseen in the legal framework in force. To this end, the method of procedure adopted is survey by means of the bibliographical research technique in published materials; and, as a method of approach, the deductive, aiming, from the analysis of child artistic work and its context, as well as the Brazilian legal system, to draw conclusions regarding the sufficiency of the Brazilian legal system to protect the rights of these children and the actions of the Judiciary and the Labor Prosecutor's Office for the balance between child artistic work and the protection of children's rights in this context. In conclusion, it is observed that the regulation of artistic work by children and adolescents is outdated, with several legislative gaps capable of generating legal insecurity, thus making its control and inspection difficult.
