Natureza jurídica dos animais

Abstract

Esta dissertação tem como objeto de pesquisa a natureza jurídica dos animais, em face da legislação brasileira, haja vista que perduram dúvidas e discussões jurisprudenciais e doutrinárias sobre o tema. A legislação não trata os animais de forma uniforme. A partir da leitura da Constituição e das normas previstas nas leis ordinárias, vê-se claramente o descompasso que existe entre elas, O Poder Judiciário, em alguns recentes julgados, tem se posicionado a dar tratamento ímpar aos animais. Parte da doutrina sustenta serem os animais sujeitos de direito, e o faz com fundamentos na própria Constituição Republicana de 1988. No decorrer deste trabalho, será visto que os seres humanos têm dedicado maior parte do seu tempo e relacionamento para com os animais e que teorias ético-filosóficas hoje são bases de pensamento para a mudança das normas quanto à natureza jurídica dos animais em diversos países ao redor do mundo e no Brasil, sendo o animal não mais considerado uma coisa para o Direito. Por fim, traçaremos um panorama sobre o trâmite e aprovação pelo Sendo Federal de projeto de lei que classifica os animais como sujeitos de direitos com acesso à tutela jurisdicional.

This paper has as its object of research the legal nature of animals, in face of Brazilian legislation, given that doubts and jurisprudential and doctrinal discussions on the subject persist. The legislation does not treat animals uniformly. From the reading of the Constitution and the norms foreseen in the ordinary laws, it is clear that there is a gap between them. The Judiciary, in some recent judgments, has positioned itself to give unequal treatment to animals. Part of the doctrine holds that animals are subject to law, and it does so on the basis of the 1988 Republican Constitution itself. In the course of this work, it will be seen that human beings have devoted most of their time and relationship to animals and that theories ethical-philosophical today are bases of thought for changing the rules regarding the legal nature of animals in Brazil and several countries around the world, being the animal no longer considered a thing for the Law. Finally, we will outline the process and approval by the Federal Government of a bill that classifies animals as subjects of rights with access to jurisdictional protection.
