Análise do marco legal da geração distribuída

Abstract

Em busca de levar à comunidade acadêmica, de forma compreensível, o cenário atualizado da Geração Distribuída, no âmbito legal e regulatório, foi realizado um estudo minucioso sobre os decretos, resoluções normativas e leis que regem o setor. Para que seja mensurável a dimensão e velocidade com que a Geração Distribuída se inseriu no setor elétrico, apresentou-se um histórico da eletricidade no Brasil. A motivação do estudo foi a Lei nº 14.300, publicada em 07 de janeiro de 2022, conhecida como o Marco Legal da Geração Distribuída, que, entre outras disposições, altera a forma como é aplicado o Sistema de Compensação de Energia Elétrica, o principal incentivo viabilizador econômico dos projetos de GD.

In order to bring to the academic community the updated scenario of Distributed Generation, in a legal and regulatory context, in a comprehensible way, a detailed study was conducted on the decrees, normative resolutions and laws that regulate the field. In order to measure the dimension and speed with which Distributed Generation has inserted itself into the electrical sector, it was presented Brazil’s electricity’s history. The motivation for the study was Law nº 14.300, published on January 07, 2022, known as the Legal Landmark of Distributed Generation, which, among other provisions, changes the way the Electricity Compensation System (Net Metering), the main incentive for economic viability of distributed generation projects, is applied.
