O cyberbullying e a violação ao direito fundamental à honra sob a égide do marco civil da Internet na sociedade digital brasileira

Abstract

Apesar de servir como um mecanismo de democratização da informação em uma conjuntura de globalização, a Internet apresenta-se, não raro, como instrumento de ameaça à diversas liberdades democráticas tuteladas pela Constituição da República Federativa do Brasil de 1988. Dentre elas, tem-se as frequentes transgressões aos direitos da personalidade constatadas nos cibercrimes, os quais são impulsionados pela falácia de um anonimato absoluto e irrestrito do meio digital. Nesse contexto, insere-se o cyberbullying, o qual define-se como um crime digital que tem como cerne a violação ao direito fundamental à honra, havendo dificuldade de enquadramento deste em um tipo penal específico, dada a ausência de regulamento por meio de lei própria. Posto isso, pretende-se estudar as implicações das lacunas normativas presentes no ordenamento jurídico brasileiro, ao explanar os pormenores oriundos de transgressões a direitos fundamentais tutelados, não raro, pela ausência de leis específicas que garantam a punibilidade efetiva de crimes virtuais, com ênfase no cyberbullying. Complementarmente, haverá análise da Lei nº 12.965/14, conhecida como Marco Civil da Internet, a qual estabelece princípios, garantias, direitos e deveres para o uso da Internet no Brasil; bem como investigar- se-á como a responsabilidade civil aplica-se àqueles que praticam o cyberbullying e aos provedores de Internet. Para atender à finalidade de tais perquirições, fora utilizado material doutrinário, decisões judiciais e pesquisa bibliográfica.

Despite serving as a mechanism for the democratization of information in a context of globalization, the Internet often presents itself as an instrument of threat to the various democratic freedoms protected by the Constitution of the Federative Republic of Brazil of 1988. Among them, there is the frequent transgressions of personality rights found in cybercrimes, which are driven by the fallacy of an absolute and unrestricted anonymity of the digital environment. In this context, cyberbullying is inserted, which is defined as a digital crime that has as its core the violation of the fundamental right to honor, with difficulty in framing it in a specific criminal type, given the absence of regulation by own law. That said, it is intended to study the implications of the normative gaps present in the Brazilian legal system, by explaining the details arising from transgressions of fundamental rights protected, not infrequently, by the absence of specific laws that guarantee the effective punishment of virtual crimes, with emphasis on the cyberbullying. Complementarily, there will be an analysis of Law nº 12.965/14, known as the Civil Rights Framework for the Internet, which establishes principles, guarantees, rights and duties for the use of the Internet in Brazil; as well as investigating how civil liability applies to those who practice cyberbullying and Internet providers. To meet the purpose of such inquiries, doctrinal material, judicial decisions and bibliographic research were used.
