Governamentalidade é um conceito da matriz foucaultiana que permite analisar a construção de regimes de verdade através da imbricação entre saberes e poderes, constituintes de subjetividades específicas. Possibilita uma análise do poder que re-historiciza a ordem social e desvela contradições próprias ao modelo normativo instituído. Nesta perspectiva, o tema desta tese é a “governamentalidade algorítmica”, de Antoinette Rouvroy e Thomas Berns (2015), que trata de representar as relações de saber-poder na atualidade e as possibilidades de resistência que os sujeitos podem desenvolver. Os dispositivos algorítmicos operam tanto a nível disciplinar, quanto biopolítico, construindo uma normatividade imanente que modula, por perfis algorítmicos que correlacionam dados, novas condições corporais. Afasta-se das estratégias dos jogos de liberdade e se aproxima da dominação, dificultando processos reflexivos necessários a outras subjetivações. Utilizando o conceito acima mencionado, busca-se enfrentar duas problemáticas: (i) uma provável transformação normativa no século XXI, transitando da forma neoliberal de governamentalidade à algorítmica, e (ii) uma colonização biopolítica da norma jurídico-discursiva mais sutil e eficaz do que a operada pelo neoliberalismo, baseada na redução da produção de ilegalismos. Em síntese, uma análise do maior potencial de dominação social permitido pelas tecnologias algorítmicas. Como hipóteses, sugere-se (i) uma autonomia da governamentalidade algorítmica em relação à neoliberal, que possibilita a construção das bases sociopolíticas e o desenvolvimento daquela tecnologia de poder, e (ii) uma mudança na estrutura normativa do campo jurídico pelo ingresso das novas tecnologias algorítmicas, redutoras do espaço discursivo de resistência e de produção de novas formas de vida. O objetivo geral é analisar a estrutura algorítmica sob o aspecto normativo (político e jurídico), com foco maior no diagnóstico do que nas formas de superação. Os objetivos específicos são: identificar a racionalidade que estrutura a ordem algorítmica; compreender suas contradições e apontar a possibilidade de críticas com respeito a processos de subjetivação.´O método da pesquisa é o genealógico. Opera principalmente com os dois primeiros campos táticos da tríade saber-poder-sujeito. São realizados cruzamentos conceituais com autores que atualizam a matriz foucaultiana; bem como com elementos da base conceitual da teoria crítica em sua versão frankfurtiana, utilizados em apoio ao exercício crítico como resistência à normatividade algorítmica. Tanto no campo político-social como no jurídico, observa-se um afastamento dos espaços de liberdade e uma aproximação da dominação cotidiana algorítmica. O bloqueio dos jogos de linguagem dificulta a profanação dos dispositivos atuais, atravessados por críticas reformistas, em vez de uma crítica radical, transformadora dos elementos estruturais da ordem social algorítmica e passível de restabelecer o espaço linguístico do comum. Tal crítica permite abrir espaço para a agência humana, em detrimento da servidão maquínica algorítmica, possibilita a reflexão sobre os perfis normativos algorítmicos e uma construção normativa diversa do modelo normativo da concorrência e do desempenho. Assim, permite o exercício democrático de indivíduos e instituições, principalmente estatais e jurídicas.

Governmentality is a concept from the Foucauldian matrix that allows for the analysis of the construction of regimes of truth through the interweaving of knowledge and power, which constitute specific subjectivities. It enables an analysis of power that re-historicizes the social order and unveils contradictions inherent in the established normative model. From this perspective, the theme of this thesis is "algorithmic governmentality," as defined by Antoinette Rouvroy and Thomas Berns (2015), which aims to represent the power-knowledge relations in the present day and the possibilities of resistance that subjects can develop. Algorithmic devices operate at both disciplinary and biopolitical levels, constructing an immanent normativity that modulates, through algorithmic profiles that correlate data, new bodily conditions. It moves away from the strategies of games of freedom and closer to domination, hindering reflexive processes necessary for other subjectivations. Using the aforementioned concept, this study seeks to address two problematic issues: (i) a probable normative transformation in the 21st century, transitioning from the neoliberal form of governmentality to the algorithmic one, and (ii) a more subtle and effective biopolitical colonization of the legal-discursive norm than that operated by neoliberalism, based on the reduction of the production of illegalities. In short, an analysis of the greater potential for social domination allowed by algorithmic technologies. As hypotheses, it is suggested (i) an autonomy of algorithmic governmentality in relation to neoliberal governmentality, which enables the construction of the sociopolitical bases and the development of that technology of power, and (ii) a change in the normative structure of the legal field through the entry of new algorithmic technologies, reducing the discursive space of resistance and the production of new forms of life. The general objective is to analyze the algorithmic structure from a normative (political and legal) perspective, focusing more on diagnosis than on ways of overcoming it. The specific objectives are: to identify the rationality that structures the algorithmic order; to understand its contradictions and to point out the possibility of critiques with respect to processes of subjectivation. The research method is genealogical. It operates mainly with the first two tactical fields of the triad knowledge-power-subject. Conceptual cross-referencing is carried out with authors who update the Foucauldian matrix; as well as with elements of the conceptual basis of critical theory in its Frankfurt School version, used in support of critical exercise as resistance to algorithmic normativity. In both the political-social and legal fields, a distancing from spaces of freedom and an approximation to everyday algorithmic domination is observed. The blockage of language games hinders the profanation of current devices, which are traversed by reformist critiques, instead of a radical critique that transforms the structural elements of the algorithmic social order and is capable of re-establishing the linguistic space of the common. Such criticism allows for the creation of space for human agency, to the detriment of algorithmic machine servitude, enables reflection on algorithmic normative profiles and a normative construction different from the normative model of competition and performance. Thus, it allows for the democratic exercise of individuals and institutions, especially state and legal ones.
