Abstract

Esta dissertação explora a temática da violência sexual infantil à luz das decisões do Superior Tribunal de Justiça (STJ). Traz à tona a relevância do estudo e a necessidade de uma resposta eficaz ao crime de estupro de vulnerável no contexto jurídico e social. O objetivo da pesquisa é analisar a jurisprudência do STJ sobre o crime de estupro de vulnerável, evidenciando a importância da prevenção à violência sexual infantil por meio de uma educação sexual integrada nas ações do Estado. A justificativa para este trabalho repousa na constatação de que, apesar da legislação existente, há lacunas na conscientização social e na aplicação prática das leis que protegem crianças e adolescentes. A metodologia utilizada envolve uma revisão crítica da literatura sobre o crime em questão, adotando os critérios da pesquisa quantitativa e documental, mais precisamente na análise das decisões judiciais proferidas pelo STJ. Além disso, propõe a implementação da educação sexual no sistema educacional e nas várias esferas dos Poderes Executivo, Legislativo e Judiciário, visando promover discussões com especialistas e educadores sobre estratégias de prevenção. Os resultados esperados incluem uma melhoria na compreensão das questões relacionadas ao tema e, sobretudo, um incremento na conscientização sobre a importância da notificação e denúncia dos possíveis crimes cometidos. Espera-se que a integração da educação sexual no currículo escolar contribua efetivamente para a proteção de crianças e adolescentes, não apenas no âmbito legal, mas também na formação de uma sociedade mais consciente e ativa na luta contra a violência sexual infantil.

This dissertation explores the theme of child sexual violence in the light of the decisions of the Superior Court of Justice (STJ). It highlights the relevance of the study, the need for an effective response to the crime of rape of a vulnerable person in the legal and social context. The aim of the research is to analyze the case law of the STJ on the crime of rape of a vulnerable person, highlighting the importance of preventing child sexual violence through sex education integrated into the actions of the State. The justification for this work lies in the fact that, despite the existing legislation, there are gaps in social awareness and in the practical application of the laws that protect children and adolescents. The methodology used involves a critical review of the literature on the crime in question, adopting the criteria of quantitative and documentary research, more precisely in the analysis of judicial decisions handed down by the STJ. In addition, it proposes the implementation of sex education in the educational system and in the various spheres of the Executive, Legislative and Judicial branches, with a view to promoting discussions with specialists and educators on prevention strategies. The expected results include an improvement in the understanding of issues related to the topic and, above all, an increase in awareness of the importance of reporting possible crimes. It is hoped that integrating sex education into the school curriculum will effectively contribute to the protection of children and adolescents, not only in the legal sphere, but also in the formation of a more aware and active society in the fight against child sexual violence.
