Abstract

A Responsabilidade do Estado por Dano Causado à Imagem. O objetivo do trabalho é realçar a importância do direito à imagem, o qual trata-se de direito da personalidade. Colocando o bem imagem na salvaguarda da própria dignidade da pessoa humana. Inicia-se tratando dos direitos da personalidade, em seguida, abre espaço para o direito à imagem, o qual é o centro da pesquisa. Por conseguinte, a violação da imagem gera dano moral e material, cuja conseqüência, é a responsabilidade. Aqui se direcionou para a responsabilidade do Estado. O direito à imagem para ser mais bem compreendido teve o seu objeto dividido em imagem objetiva e imagem subjetiva, a primeira a significar visual, material, como fotografia, pintura etc, a segunda a dizer mental, imaterial, como a concebida a partir de certas condutas ou comportamentos esperados ou praticados no âmbito da vida em sociedade. Conclui-se que o Estado Democrático de Direito tem muito que se esforçar para garantir e resguardar o direito à imagem contra os abusos de seus agentes; e, a responsabilidade objetiva do Estado, alcunhada de risco administrativo, é a que encontra amparo na Constituição da República Federativa do Brasil.

The Responsibility of the State for Actual damage to the Image. The objective of the work is to enhance the importance of the right to the image, which is about right of the personality. Placing well the image in it safeguards of the proper dignity of the person human being. It is initiated treating to the rights of the personality, after that, opens space for the right to the image, which is the center of the research. Therefore, the breaking of the image generates pain and suffering and material, whose consequence, is the responsibility. Here it was directed for the responsibility of the State. The right to the to be understood image most had its object divided in objective image and subjective image, the first one to mean appearance, material, as photograph, painting etc, second to say mental, incorporeal, as conceived from certain behaviors or behaviors waited or practised in the scope of the life in society. One concludes that the Democratic State of Right has much that if to strengthen to guarantee and to protect the right to the image against the abuses of its agents; e, the objective responsibility of the State, alcunhada of administrative risk, are the one that finds support in the Constitution of the Federative Republic of Brazil.
