Resumo
Este trabalho tem por finalidade efetuar uma análise tanto sobre a necessidade de emancipação que o cidadão possui, de modo a ser tornar agente atuante dentro ordenamento jurídico, quanto sobre o instrumento probatório da ata notarial, a ser por ele utilizado, em juízo e fora dele. Para tanto, foi destacado do rol do sexto artigo do texto constitucional o direito ao transporte, aqui delimitado exclusivamente no que toca ao transporte público coletivo, entendido esse como um serviço a ser prestado pelo Estado de maneira satisfatória. Dessa maneira, inicialmente, se demonstra a fundamentalidade dos direitos sociais, especificando-se as características do destacado direito social, para então se investigar, pormenorizadamente, as condições que terminam por aprisionar o cidadão. Na sequência, se investiga o instrumento em si considerado, não sem antes estudar seu autor, no caso, o tabelião de notas. Destarte, o objeto da pesquisa se apresenta na vanguarda da atual conjuntura processual civil, uma vez que supera a pura questão dogmática de delimitação de seus conceitos, para adentrar a problemática da efetividade do direito material, trabalhando no paradigma do Novo Código de Processo Civil. A metodologia escolhida combina distintos enfoques metódicos, destacando-se o método indutivo como método de abordagem, sobre a qual atuou também a contemporânea abordagem baseada em direitos, desde o recorte temático, assim como no desenvolvimento do estudo. A pesquisa não se coloca como salvação para a questão da efetividade do Direito, mas sim como meio de instigar o leitor a pensar em novas formas de se caminhar nesse sentido. Dessa forma, se espera contribuir tanto para a iluminação da necessidade de fortalecimento do cidadão como tal, como para o surgimento de uma doutrina nacional da ata notarial e, secundariamente, da própria função notarial.
The purpose of this study is to analyze both the need for emancipation that the citizen possesses, in order to become an acting agent within the legal system, and the probative instrument of the notarial act, to be used by him, in and out of the courthouse. Therefore, the right to public transportation was selected of the sixth article of the constitutional text, at this point limited exclusively to the collective public transportation, here understood as a service to be provided by the State in a satisfactory manner. In this way, initially, the fundamentality of social rights is highlighted, specifying the characteristics of the chosen social right, to further investigate in detail the conditions that end up imprisoning the citizen. In sequence, the considered instrument is investigated itself, not without first studying its author, in this case, the public notary. Hence, the object of the research is at the forefront of the current civil procedural context, as it overcomes the purely dogmatic issue of delimitation of its concepts, in order to scrutinize the problematic of the effectiveness of material law, working on the paradigm of the New Code of Civil Procedure. The elected methodology combines different methodical techniques, emphasizing the inductive method as a method of procedure, relying also on the contemporary rights-based approach, since the initial thematic choice, as well as in the development of the study. The research does not propose itself as a final solution for the issue of the effectiveness of the law of the land, but rather its meant to instigate the reader to think of new ways of moving in that direction. Along these lines, it is hoped to contribute both to the illumination of the need to strengthen the citizen as such, as to the emerging national doctrine of the notarial act and, secondarily, of the notarial function itself.
