A citação de obras artísticas em decisões judiciais pode facilitar o acesso à linguagem jurídica?

Abstract

O acesso à justiça é direito fundamental previsto pela Constituição Federal. No entanto, existem diversas barreiras que impedem a plena efetivação desse direito. É o caso da barreira de linguagem. O linguajar utilizado no meio judiciário é caracterizado pelo rebuscamento excessivo e uso desnecessário de termos técnicos. Como consequência, considerável parcela da população não compreende plenamente os pronunciamentos do judiciário, de forma a comprometer seu direito ao acesso à justiça, bem como a sua cidadania. Frente a essa situação, nota-se a necessidade de repensar a linguagem utilizada no meio judiciário para torná-la mais acessível a toda a população. Como forma alternativa à tradicional linguagem do judiciário, destaca-se um artifício já utilizado por alguns juízes: a citação de obras artísticas em seus pronunciamentos. Portanto, o presente trabalho tem como objetivo analisar se a citação de obras artísticas em decisões judiciais pode facilitar o acesso à linguagem jurídica. Para a execução, foi realizada pesquisa bibliográfica e análise de decisões judiciais. Como resultado, foi constatado que a linguagem artística possui a potencialidade de promover a expansão do pensamento e reflexão crítica acerca da realidade, o que aproxima os textos jurídicos do meio social. Dessa maneira, a citação de obras artísticas em decisões judiciais pode ser empregada como um facilitador para a compreensão dos debates jurídicos por parte da população.

Access to justice is a fundamental right guaranteed by the Federal Constitution. However, several barriers prevent the full realization of this right. One example is the language barrier. The jargon used in the judicial system is characterized by excessive embellishment and unnecessary use of technical terms. As a result, a considerable portion of the population does not fully understand judicial rulings, compromising their right to access justice and their citizenship. Given this situation, there is a clear need to rethink the language used in the judicial system to make it more accessible to the entire population. As an alternative to the traditional judicial language, a device already used by some judges stands out: citing artistic works in their rulings. Therefore, this paper aims to analyze whether citing artistic works in judicial decisions can facilitate access to legal language. For this purpose, bibliographical research and analysis of judicial decisions were conducted. As a result, it was found that artistic language has the potential to promote the expansion of thought and critical reflection on reality, which brings legal texts closer to the social environment. Thus, citing artistic works in judicial decisions can be used to facilitate the public's understanding of legal debates.
