O registro civil da filiação socioafetiva no direito brasileiro

Abstract

A concepção contemporânea do direito de família, fundamentada na afetividade e na dignidade da pessoa humana, conduziu à necessidade de reconhecimento jurídico à um antigo fato social: a filiação socioafetiva. Assim como todos os vínculos filiativos, a parentalidade constituída com base no afeto e na posse do estado de filho (desvinculada de origem biológica ou adotiva) também necessita ser inserida no assento de nascimento para que os cidadãos que a vivenciem possam exercer todos os direitos que titularizam como pais, mães e filhos. Ocorre, contudo, que o ordenamento brasileiro jamais se expressou taxativamente sobre a filiação socioafetiva, sendo que a referida inércia legislativa representou por muito tempo um entrave ao registro civil de tal vínculo familiar. Atualmente o registro civil da filiação socioafetiva é uma realidade em solo nacional graças ao hercúleo trabalho desenvolvido conjuntamente pela doutrina, jurisprudência, corregedorias gerais de justiça das unidades federativas e do Conselho Nacional de Justiça, os quais acabaram por criar mecanismos jurídicos viabilizadores do registro civil da nova espécie filiativa sem que seja necessário solicitar autorização ao poder judiciário para a prática de ato. Observa-se que muito embora o instituto da filiação socioafetiva já seja reconhecido pelo direito e dotado de efetividade prática, este ainda encontra-se carente de regulamentação normativa adequada a suprir todas as dúvidas e dificuldades práticas que o tema gera.

The contemporary conception of family law, based on the affectivity and dignity of the human person, led to the need for juridical recognition of an old social fact: socio-affective affiliation. Like all affiliative links, parenting based on affection and possession of the child's state (unrelated to biological or adoptive origin) also needs to be inserted in the birth seat so that the citizens who experience it can exercise all the rights they have. as parents, mothers and children. It occurs, however, that the Brazilian legal system has never been expressly expressed on socio-affective affiliation, and that legislative inertia has long been an obstacle to the civil registry of such family ties. Nowadays, civil registration of socio-affective affiliation is a reality in national soil thanks to the herculean work developed jointly by the doctrine, jurisprudence, general corregedorias of justice of the federative units and of the National Council of Justice, which ended up creating legal mechanisms for the civil registry of the new filiative species without the need to request authorization from the judiciary for the practice of the act. It is observed that although the institute of socio-affective affiliation is already recognized by law and endowed with practical effectiveness, it is still lacking normative regulation adequate to fill all the doubts and practical difficulties that the subject generates.
