A dignidade da pessoa humana e os direitos fundamentais em Torto arado, de Itamar Vieira Junior

Abstract

O estudo comparado entre Literatura e Direito possibilita a expansão do horizonte de conhecimento, modificando a forma como cada disciplina é entendida e analisada. A Literatura como um produto humano, possui a capacidade de humanizar as situações vivenciadas e veicular discursos com engajamento social, ampliando o campo de visão do leitor e modificando a imagem que ele possui de si e do mundo. Com o objetivo de disciplinar as relações sociais e possibilitar a convivência social, o Direito impõe regras de conduta, em busca de um bem-estar coletivo, limitando a liberdade individual. Para isso, o operador do Direito deve regulamentar o maior número de situações possíveis, porém, a finitude da vida o impede de ter contato com todas elas. E é esse o ponto de intersecção entre as mencionadas disciplinas, pois a Literatura passa a ser uma fonte de experiências humanas, impactando o mundo a sua volta, inclusive e o Direito. Em Torto arado é possível extrair alguns temas sensíveis e analisá-los com base no ordenamento jurídico, desde a origem da positivação, evolução e a forma como estão regulamentados atualmente. O trabalho rural em condições análogas à escravidão, a propriedade da terra como instrumento que perpetua a desigualdade social, a importância das movimentações sociais materializadas nas entidades sindicais, a luta das mulheres negras e pobres em uma sociedade patriarcal e o papel da educação e da religião na transformação e promoção da igualdade social, serão alguns dos assuntos abordados sob o âmbito literário e jurídico. Ver-se-á, ainda, que tais direitos são inerentes ao princípio da dignidade da pessoa humana, cerne de todo o ordenamento jurídico e sob o qual gravitam todos os demais direitos fundamentais. Restará evidenciado, portanto, que existe uma farta legislação sobre os assuntos desenvolvidos, que visam a proteção e a promoção da igualdade, mas que carece de aplicabilidade no mundo fático. Assim, o que se busca é demonstrar que a Literatura tem um importante papel no processo de identificação do homem com o próximo e do surgimento dos sentimentos de empatia e compaixão, fazendo com que os leitores e a sociedade de um modo geral sejam mais compreensivos em relação aos seus semelhantes, culminando na modificação do direito e na sua maior efetividade.

The comparative study between Law and Literature allows the expansion of the horizon of knowledge, modifying the way in which each discipline is understood and analyzed. Literature, as a human product, has the ability to humanize experienced situations and convey discourses with social engagement, broadening the reader's field of vision and changing their image of themselves and the world. With the aim of disciplining social relations and enabling social coexistence, Law imposes rules of conduct, seeking collective well-being, limiting individual freedom. To this end, the legal practitioner must regulate as many situations as possible, however, the finiteness of life prevents him from having contact with all of them. And this is the point at which the disciplines intersect, since Literature becomes a source of human experiences, impacting the world around it and the law. In Torto Arado it is possible to extract some sensitive themes and analyze them based on the legal system, from the origin of positivization, its evolution and the way in which they are currently regulated. Rural labor in conditions analogous to slavery, land ownership as an instrument that perpetuates social inequality, the importance of social movements embodied in trade unions, the struggle of poor black women in a patriarchal society, and the role of education and religion in the transformation and promotion of social equality will be some of the topics addressed in the literary and legal spheres. It will also be seen that such rights are inherent to the principle of human dignity, the core of the entire legal system and under which all other fundamental rights gravitate. It will therefore be evident that there is ample legislation on the subjects discussed, which aims to protect and promote equality, but which lacks applicability in the real world. Thus, the aim is to demonstrate that Literature plays an important role in the process of identification between man and his fellow man and in the emergence of feelings of empathy and compassion, making readers and society in general more understanding of their fellow men, culminating in the modification of the law and its greater effectiveness.
