Filiação por útero artificial ab initio: liberdade de reprodução humana ou ferramenta de biopoder?

Abstract

O presente trabalho visa analisar — na temática de reprodução humana assistida, especificamente na possibilidade de uso ab initio da iminente técnica denominada útero artificial — a dicotomia referente à liberdade da reprodução e à restrição do biopoder para, assim, entender sob quais fundamentos deverá ser efetivada a necessária tutela jurídica dos indivíduos que assim serão originados. Para tanto, analisar-se-á a afetação desse tipo de procriação humana na formação desses filhos bem como no conceito de relação parento-filial na sociedade em que vivem. Assim, serão estudados fatores histórico-sociais, biotecnológicos, jurídicos e psicológicos sobre a questão, para se verificar de que modo a gestação artificial poderá ocasionar consequências tanto individuais, na vida dos diretamente envolvidos, quanto coletivas, em uma eventual biopolítica. Ainda, tendo em vista que os úteros artificiais serão uma realidade à disposição da procriação humana e que o papel do Direito é regular as relações da sociedade, buscar-se-á analisar os conteúdos levantados mediante um viés filosófico e sociojurídico, bem como verificar qual seria a fundamentação para se proteger juridicamente essa prole. Nesse sentido, pelas abordagens hipotético-dedutiva e dialética se pretende construir uma pesquisa teórica fundada, sobretudo, nas técnicas de pesquisa bibliográfica e documental. Outrossim, a pesquisa objetivada apresenta natureza básico-estratégica, uma vez que se dispõe à produção de conhecimento teórico com possíveis consequências refletidas também na realidade social. Desse modo, pela abordagem qualitativa, pretende-se compreender e interpretar os dados estudados para, por fim, entendendo-se a dicotomia na qual o tema está inserido, ou seja, entre as propostas de liberdade reprodutiva e de restrição do biopoder, contribuir para o embasamento de dispositivos legais de proteção e efetivação dos direitos fundamentais, em condições de liberdade e de dignidade, dos filhos havidos pelo futuro método dos úteros artificiais.

The present project aims to analyze — in the theme of assisted human reproduction, specifically in the possibility of ab initio use of the imminent technique called artificial uterus — the dichotomy referring to the freedom of reproduction and the restriction of biopower, in order to understand under what foundations it should be carried out. the necessary legal protection of the individuals who will thus be originated. Therefore, the affectation of this type of human procreation in the formation of these children will be analyzed, as well as in the concept of parent-child relationship in the society in which they live. Thus, historical-social, biotechnological, legal and psychological factors will be studied on the issue, in order to verify how artificial pregnancy can cause consequences both individually, in the lives of those directly involved, and collectively, in an eventual biopolitics. Still, bearing in mind that artificial wombs will be a reality at the disposal of human procreation and that the role of law is to regulate society's relations, an attempt will be made to analyze the contents raised through a philosophical and socio-legal bias, as well as to verify which would be the basis for legally protecting this offspring. In this sense, through the hypothetical-deductive and dialectical approaches, it is intended to build a theoretical research, based, above all, on bibliographical and documental research techniques. Furthermore, the objectified research has a basic-strategic nature, since it is willing to produce theoretical knowledge with possible consequences also reflected in social reality. Thus, through a qualitative approach, it is intended to understand and interpret the data studied in order to, finally, understanding the dichotomy in which the theme is inserted, that is, between the proposals of reproductive freedom and restriction of biopower, to contribute to the basis of legal provisions for the protection and enforcement of fundamental rights, in conditions of freedom and dignity, of children born by the future method of artificial wombs.
