A Ocupação Israelense na Palestina e o papel do Direito Internacional na proteção dos civis afetados pelo conflito

Abstract

A ocupação dos territórios palestinos exercida pelas forças do Estado de Israel é um longo processo de ocupação beligerante iniciado pelos desdobramentos da Guerra dos Seis Dias, que completou 55 anos em 2022 sem que se vislumbrem saídas pacíficas para o conflito. A conduta adotada pelo poder ocupante impôs ao longo de mais de meio século uma realidade de violências e privações à população dos territórios ocupados, dentre as quais destaca-se a construção de uma barreira física, o Muro da Cisjordânia, em território palestino ocupado, sob a justificativa prevenção de atos terroristas. Neste contexto, o objeto central do presente trabalho é a investigação acerca das repercussões jurídicas das violações oriundas deste conflito no âmbito do direito internacional público e do direito internacional humanitário. Para tal feito, utilizou-se como metodologia a revisão bibliográfica, onde a partir desta metodologia o estudo buscou compreender os processos históricos e políticos que deram origem aos conflitos entre palestinos e israelenses, assim como a compreensão da tutela jurídica dos direitos humanos diante dos conflitos internacionais e ocupações beligerantes. Dessarte, o presente trabalho busca analisar de maneira crítica o conflito Israel-Palestina e papel do direito na proteção dos povos afetados pelos conflitos, assim como as limitações de sua aplicabilidade.

The occupation of Palestinian territories by the forces of the State of Israel is a long process of belligerent occupation that began as a result of the Six-Day War and completed 55 years in 2022, with no peaceful solutions to the conflict in sight. The conduct adopted by the occupying power has imposed a reality of violence and deprivation on the population of the occupied territories for over half a century, including the construction of a physical barrier, the Wall in the West Bank, on occupied Palestinian territory, under the justification of preventing terrorist acts. In this context, the central objective of this paper is to investigate the legal repercussions of the violations arising from this conflict within the scope of international public law and international humanitarian law. For this purpose, a literature review was conducted as the methodology, aiming to understand the historical and political processes that gave rise to the conflicts between Palestinians and Israelis, as well as the understanding of the legal protection of human rights in the face of international conflicts and belligerent occupations. Therefore, this paper seeks to critically analyze the Israel-Palestine conflict and the role of law in protecting the peoples affected by the conflicts, as well as the limitations of its applicability.
