Pedidos de perdão régio no Portugal século XV (1433-1438).

Durante o reinado de D. Duarte (1433-1438), Portugal assistiu à promulgação de uma série de cartas de perdão e de dois perdões gerais concedidos pela coroa e destinados a suspender, amenizar ou mudar alguma pena ou sentença conferida a seus súditos. Aqueles que, nessa altura, solicitavam o perdão régio, argumentavam em defesa da sua dignidade e dos seus atos, justificavam suas intenções e tentavam remediar o malefício causado. Ao monarca cabia, seguindo os valores fundantes da moral cristã, o exercício da misericórdia e da justiça para com os seus súditos, analisando as circunstâncias dos seus erros e cedendo ou não o benefício de acordo com a sua consciência. Neste estudo, tendo em vista a relação entre as condições do reino, o poder régio e as justificativas apresentadas, são investigados como, nos escritos legislativos e nas cartas de perdão, os súditos portugueses do Quatrocentos, amparados pelos juízos morais difusos no período, declararam suas motivações, suas culpas, sua inocência ou seu arrependimento pelo malefício causado.

Abstract (english)

During the reign of King Duarte (1433-1438), Portugal witnessed the promulgation of a series of letters of pardon and two general pardons granted by the crown and intended to suspend, mitigate or change some punishment or sentence given to its subjects. Those who, at that time, requested royal pardon argued in defense of their dignity and their actions, justified their intentions and tried to remedy the harm caused. In accordance with the founding values of Christian morality, it was up to the monarch to exercise mercy and justice towards his subjects, analyzing the circumstances of their errors and granting or not the benefit according to his conscience. In this study, taking into account the relationship between the conditions of the kingdom, the royal power and the justifications presented, we investigate how, in legislative writings and letters of pardon, Portuguese subjects of the 15th century, supported by the moral judgments diffused in the period, declared their motivations, their guilt, their innocence or their repentance for the harm caused.
