O lugar atribuído ao filho na cena da disputa parental judicial: uma perspectiva psicanalítica

Abstract

A presente pesquisa objetiva compreender o lugar do filho como sujeito na composição familiar durante o processo judicial litigioso na disputa pela guarda. Trata-se de uma pesquisa qualitativa, baseada no enfoque teórico da Psicanálise e Psicanálise de Casal e Família, originada no cotidiano de trabalho da pesquisadora no Setor Técnico do Tribunal de Justiça do Estado de São Paulo. Foi realizado o estudo de três casos, com amostra de casais com filhos entre seis e dez anos de idade, que viveram conjugalmente e que se encontram em processo litigioso pela guarda parental. A análise foi realizada a partir de reminiscências e de anotações dos casos, e em todos eles, durante o processo de avaliação, foram utilizadas entrevistas, observação da interação, observação lúdica e o Procedimento de Desenhos de Famílias com estórias – DFE (Trinca, 2020). Os dados apontam para o indicativo de que o lugar atribuído e a inserção do filho no psiquismo familiar foram cunhados a partir do estabelecimento da trama conjugal, a qual apresentava conflitos e dificuldades desde o início. Assim, diante do rompimento conjugal em meio a crises que se sucederam durante a história da família, o processo de litígio ocorreu como um caminho possível para a resolução de todos os conflitos que permeavam a vida do casal, incluindo o filho. Na realidade, a existência de crises conjugais, presentes desde o início, incidiram no estabelecimento do contrato narcísico, afetando tanto os investimentos narcísicos como o lugar oferecido à criança, tendo continuidade durante a disputa litigiosa. Dessa maneira, as necessidades e o sofrimento dos filhos não são considerados durante o processo, exacerbando o sofrimento filial, aliado ao desamparo e ao temor da perda vivenciados, demonstrando a desmalhagem dos vínculos familiares e o trabalho psíquico que será necessário para a recomposição do tecido familiar.

The present research aims to understand the child's place as a subject in the family composition during the litigious legal process in the custody dispute. This is a qualitative research, based on the theoretical approach of Psychoanalysis and Couple and Family Psychoanalysis, originating in the researcher's daily work in the Technical Sector of the Court of Justice of the State of São Paulo. A study of three cases was carried out, with a sample of couples with children between six and ten years of age, who lived together and who are in litigation over parental custody. The analysis was carried out based on reminiscences and case notes, and in all of them, interviews, interaction observation, playful observation and the Family Drawing Procedure with Stories – DFE were used during the evaluation process (Trinca, 2020). The data point to the indication that the place assigned and the inclusion of the child in the family psyche were created from the establishment of the marital plot, which presented conflicts and difficulties from the beginning. Thus, faced with marital breakdown amid crises that occurred throughout the family's history, the litigation process occurred as a possible path to resolving all the conflicts that permeated the couple's life, including their child. In reality, the existence of marital crises, present from the beginning, affected the establishment of the narcissistic contract, affecting both the narcissistic investments and the place offered to the child, continuing throughout the contentious dispute. In this way, the children's needs and suffering are not considered during the process, exacerbating filial suffering, combined with the experienced helplessness and fear of loss, demonstrating the disintegration of family bonds and the psychic work that will be necessary to rebuild the familiar fabric.
