A pesquisa tem por objetivo analisar o fundamento dos direitos humanos em ―As origens do totalitarismo‖ de Hannah Arendt, bem como o porquê de tais direitos se apresentarem de modo frágil em sua aplicação efetiva. Observando como a noção de direitos humanos evoluiu no decorrer da história, o presente estudo busca retomar leituras de certos contextos em que a fragilidade de tais direitos ficou mais explícita, fazendo-o, sobretudo, por meio da leitura crítica que Hannah Arendt apresenta em algumas de suas obras sobre o mesmo tema. O cenário de uma democracia instável implica na formação de um contexto propício para o enfraquecimento da efetivação dos direitos humanos, visto que o cumprimento destes está diretamente ligado à relação que o sujeito mantém com o Estado. Visando compreender de que maneira os direitos humanos se apresentam em um contexto de ruptura política, o trabalho em pauta não se ocupa com questionar a importância das declarações de direitos na emancipação e resistência ao arbítrio, mas, sim, com pensar criticamente a respeito de sua efetividade quanto à tutela jurídica da vida humana.

The research aims to analyze the foundation of human rights in ―Origins of totalitarianism‖ Hannah Arendt, as well as why such rights are fragile in their effective application. Observing how the notion of human rights has evolved over the course of history, the present study seeks to resume reading of certain contexts in which the fragility of such rights became more explicit, doing it, above all, through the critical reading that Hannah Arendt presents in some of his works on the same topic. The scene of an unstable democracy implies the formation of a context conducive to the failure of the realization of human rights, since the fulfillment of these is directly linked to the relationship that the subject maintains with the State. In order to understand how human rights are presented in a context of political rupture, the work in question is not concerned with questioning the importance of declarations of rights in emancipation and resistance to arbitrariness, but with thinking critically about their effectiveness regarding the legal protection of human life.
