O afeto, ainda que mola propulsora das relações humanas, é por sua própria natureza componente abstrato de complexa observação, de modo que sua aplicabilidade, por um longo período de tempo, restou esvaziada no direito. Assim, quando enfim alçado a posição de fato jurídico, identificando-se, pois, enquanto princípio norteador das relações intrafamiliares, o afeto passou a identificar-se enquanto substancialmente um Direito de Personalidade inafastável, garantido a todos em seus núcleos familiares. Nesse sentido, cuida-se a presente monografia acerca da análisedos meandros do abandono afetivo inverso, instituto este que, em total contraponto à afetividade enquanto bem jurídico a ser preservado, representa verdadeira violação ao dever de cuidado objetivo. Para tanto, por meio de um procedimento indutivo bibliográfico, com uma abordagem discursiva, buscou-se analisar os conceitos de família e idoso na perspectiva das mudanças paradigmáticas sofridas por esses institutos bem como o afeto em sua esfera jurídica, investigando-se a possibilidade de responsabilização civil dos filhos em face do abandono de seusgenitores idosos, assim como outros eventuais efeitos sucessórios, como a expectação de fazer valer os institutos da deserdação e da indignidade que, em suma, configurariam sanções necessárias face a violação do princípio da afetividade no abandono afetivo inverso. Para tal propósito, buscou-se realizar apreciação objetiva dos princípios pertinentes ao tema, tal-qualmente de seus fundamentos legais e possíveis precedentes, concluindo-se, pois, pela compreensão de que cabe, de forma inequívoca, a responsabilização civil e os demais efeitos sucessórios supra no que se refere ao abandono afetivo de pais idosos, em razão, precipuamente, das consequências deletérias à saúde e ao bem-estar desses indivíduos, excepcionalmente no que tangencia-se ao campo psicológico.

Affection, although the driving force of human relations, is by its very nature an abstract component of complex observation, so that its applicability, for a long period of time, remained empty in law. Thus, when finally raised to the position of a legal fact, identifying itself as a guiding principle of intra-family relations, affection started to be identified as substantially an unassailable Right of Personality, guaranteed to all in their family nuclei. In this sense, the present monographies about the analysis of the intricacies of inverse affective abandonment, an institution which, in total opposition to affection as a legal good to be preserved, represents a real violation of the duty of objective care. To do so, by means of a bibliographical inductive procedure, with a discursive approach, it was sought to analyze the concepts of family and elderly from the perspective of the paradigmatic changes suffered by these institutes as well as affection in its legal sphere, investigating the possibility of civil liability of children in the face of abandonment by their elderly parents, as well as other possible succession effects, such as the expectation of enforcing the institutes of disinheritance and unworthiness which, in short, would configure necessary sanctions in the face of violation of the principle of affectivity in the inverse affective abandonment. For this purpose, it was sought to perform an objective assessment of the principles relevant to the subject, such as their legal foundations and possible precedents, concluding, therefore, by understanding that it is unequivocally the civil liability and other succession effects above regarding the affective abandonment of elderly parents, due primarily to the deleterious consequences to health and well-being of these individuals, exceptionally in what concerns the psychological field.
