Esta Dissertação se situa no campo da Filosofia e Filosofia da Educação e se insere na Linha I (Desenvolvimento Humano, Diferença e Valores) do Programa de Mestrado em Educação da FCT/UNESP, e objetiva refletir acerca da importância da promoção dos Direitos Humanos, em uma perspectiva contra-hegemônica, principalmente na educação formal, como modo de garantir uma sociedade mais justa, solidária e que saiba lidar com as diversidades existentes entre as pessoas. Além disso, pretende observar as práticas da Defensoria Pública, instituição pública prevista na Constituição Federal (art. 134), como instituição permanente, essencial à função jurisdicional do Estado, incumbindo-lhe, como expressão e instrumento do regime democrático, fundamentalmente, a orientação jurídica, a promoção dos direitos humanos e a defesa em todos os graus, judicial e extrajudicial, dos direitos individuais e coletivos, de forma integral e gratuita àqueles e àquelas que delas necessitem, nos termos do inciso LXXIV, do Art. 5º, da mesma Constituição. O problema central da pesquisa é a parceria ainda pouco consistente da Defensoria com a educação formal, na promoção dos direitos humanos. Como objetivo geral, tem-se a intenção de compreender em que bases está sendo organizada a dedicação efetiva da Defensoria do Estado de São Paulo à educação em direitos humanos, junto à educação escolar. Para tanto, os objetivos específicos são verificar como estão sendo realizados os projetos e práticas de educação em direitos humanos, principalmente junto às escolas, pela Defensoria Pública do Estado de São Paulo, entender a natureza desses projetos, desafios e dificuldades, discutir possibilidades para a concretização de uma cultura em direitos humanos e refletir sobre a importância da dedicação efetiva da Defensoria do Estado de São Paulo à educação em direitos humanos, junto às escolas. No tocante à metodologia utilizada, em uma breve síntese, parte-se da análise de conteúdo dos documentos escolhidos, com base em Bardin (2011), uma análise categorial. E, por fim, conclui-se no sentido da necessidade da intensificação da educação em direitos humanos, principalmente junto às escolas, em uma perspectiva não hegemônica, em parceria com a Defensoria Pública.
Abstract (english)
This Dissertation is located in the field of Philosophy and Philosophy of Education, Master's Program in Education, in Line I (Human Development, Difference and Values) and aims to reflect the importance of promoting Human Rights, in a counter-hegemonic perspective, mainly in education formal, as a way of guaranteeing a fairer, more solidary society that knows how to deal with the differences that exist between people. In addition, it intends to observe the practices of the Public Defender's Office, a public institution foreseen in the Federal Constitution (art. 134), as a permanent institution, essential to the jurisdictional function of the State, incumbent upon it, as an expression and instrument of the democratic regime, fundamentally, the guidance legal protection, the promotion of human rights and the defense at all levels, judicial and extrajudicial, of individual and collective rights, integrally and free of charge to those who need them, under the terms of item LXXIV, of Art. 5 of the same Constitution. The central problem of the research is the inconsistent partnership of the Ombudsman with formal education in the promotion of human rights in a counter-hegemonic perspective. As a general objective, the intention is to understand on what bases the effective dedication of the São Paulo State Defender's Office to human rights education is being organized together with school education. Therefore, the specific objectives are to verify how projects and practices of education in human rights are being carried out, mainly in schools, by the Public Defender of the State of São Paulo; understand the nature of these projects, challenges, difficulties; discuss possibilities for the realization of a human rights culture and; reflect on the importance of the effective dedication of the São Paulo State Defender's Office to human rights education in schools. Regarding the methodology used, in a brief summary, we start from the content analysis of the chosen documents, based on Bardin (2011), a categorical analysis. And, finally, we conclude with the need to intensify human rights education, especially in schools, from a non-hegemonic perspective, in partnership with the Public Defender's Office.
