O acesso à internet como garantia fundamental: os efeitos das novas tecnologias nos direitos fundamentais

Abstract

A vida na contemporaneidade ocorre de modo indissociado da crescente comunicação intercultural, isso diz não somente sobre a velocidade em que as informações são transmitidas, mas sobre o desejo do ser humano de comunicar. Este amplo uso de novas tecnologias da informação, especificamente a internet, impactou as mais diversas áreas da sociedade e é sob a luz de tais transformações que o presente trabalho busca analisar o acesso à internet como garantia fundamental. Para esse fim, disserta-se acerca dos Direitos humanos, Direitos fundamentais e as suas respectivas gerações, aspectos essenciais sobre a Internet, juntamente às disposições normativas que abrangem a temática, refletindo acerca da Rede constituir um espaço de integração que deve reconhecer cada homem como um ser de Direitos e Deveres, o qual todos devem ter o direito de participação. Dessa maneira, pretende-se ponderar a respeito da existência do direito de acesso à internet e considerar que lhe seja conferido o nível de garantia fundamental no Brasil.

Life in contemporary times occurs inseparably from the growing intercultural communication, this says not only about the speed at which information is transmitted, but about the desire of human beings to communicate. This wide use of new information technologies, specifically the internet, has impacted the most diverse areas of society and it is in the light of such transformations that the present work seeks to analyze internet access as a fundamental guarantee. To this end, it discusses human rights, fundamental rights and their respective generations, essential aspects of the Internet, together with the normative provisions that cover the subject, reflecting on the Network being an integration space that must recognize each man as a a being of Rights and Duties, in which everyone should have the right to participate. In this way, it is intended to consider the existence of the right of access to the internet and consider that it is conferred the level of fundamental guarantee in Brazil.
