Conflitos em Antígone, de Sófocles: entre a lei e a justiça

Abstract

A presente dissertação propõe uma análise interdisciplinar da tragédia Antígone (2009), de Sófocles, com o objetivo de explorar a interseção entre Direito e Literatura, a partir da tensão entre o direito divino e o direito positivo. O estudo busca demonstrar a relevância contínua da tragédia grega para debates sobre justiça, a fim de defender a necessidade de uma abordagem interdisciplinar que melhor compreenda os fenômenos jurídicos e suas implicações na sociedade hodierna. A tragédia, além de seu valor estético, desempenha uma função social e catártica ao educar por meio da experiência emocional do espectador. Em Antígone, elementos como hamartia e hybris estruturam o desenvolvimento da protagonista e conduzem à catarse, destacando os riscos da aplicação inflexível das leis e da ausência de ponderação entre normas jurídicas e princípios de justiça. A obra apresenta-se como um campo fértil para a reflexão sobre o Direito, especialmente no que diz respeito aos conflitos entre deveres religiosos e normas estatais. A dissertação organiza-se em quatro capítulos, que abordam desde o contexto jurídico da Grécia Antiga e a interação entre direito costumeiro e direito positivo até a aplicação contemporânea dos conceitos de jusnaturalismo e juspositivismo. Com base em autores como Aristóteles e Nietzsche, a pesquisa examina os fundamentos filosóficos da tragédia e sua relação com o pensamento jurídico. O estudo inclui uma análise detalhada da peça, explorando sua contextualização histórica, argumento central, estrutura dramática, personagens e a trajetória da linhagem dos Labdácidas. Também investiga a falta de diálogo entre Creon e Antígone, destacando a relevância do embate entre autoridade estatal e deveres individuais. Além disso, analisa-se o papel do Coro como mediador entre os eventos da peça e a justiça coletiva, observando-se suas ambiguidades e limitações diante das decisões políticas e jurídicas da tragédia. A comparação entre o contexto antigo e os desafios contemporâneos demonstra como Antígone permanece como um referencial essencial para a compreensão das tensões entre legalidade e justiça, bem como para o debate sobre a responsabilidade dos governantes na aplicação do direito. A dissertação conclui que a interseção entre Literatura e Direito não apenas enriquece o campo teórico dessas mesmas áreas, mas, também, contribui para o aprimoramento da sociedade por meio de um viés humanístico e crítico. A tragédia sofocliana ilustra os perigos da inflexibilidade normativa e propõe uma reflexão sobre a necessidade de equilibrar as leis humanas com valores éticos universais. Por fim, a pesquisa destaca a importância da literatura clássica para o desenvolvimento do pensamento jurídico e para a formação de uma visão mais ampla e humanística da justiça.

This thesis provides an interdisciplinary analysis of The Tragedy of Antigone (2009), exploring a close relationship between law and literature and focusing on both divine law and positive law. The study aims at demonstrating a permanent influence of Greek tragedy to discussions related to justice, posting the need of an interdisciplinary approach to better understand legal phenomena and their implications in contemporary society. Beyond its aesthetic value, the Greek tragedy plays a social and cathartic role by educating through the spectator's emotional experience. In Antigone, elements such as hamartia and hybris structure the main character's development while lead to catharsis, highlighting the risks of the inflexible application of laws and the lack of consideration for the relationship between legal norms and principles of justice. The play presents itself as a fertile field for the reflection on Law, especially concerning conflicts between religious duties and state norms. The thesis is organized into four chapters which cover from the legal context of Ancient Greece—including the interaction between customary law and positive law—to the contemporary application of the concepts of natural law and positivism. Based on authors such as Aristotle and Nietzsche, it examines the philosophical foundations of tragedy and its relationship to legal thought. This study includes a detailed analysis of the play, exploring its historical context, main argument, dramatic structure, characters, and the trajectory of the Labdacid lineage. Also, this thesis investigates the lack of dialogue between Creon and Antigone, emphasizing the relevance of the clash between state authority and individual duties. Additionally, it analyzes the role of the Chorus as a mediator between the events of the play and collective justice, exploring its ambiguities and limitations in face of the political and legal decisions of the tragedy. The comparison between the ancient context and contemporary challenges demonstrates how Antigone remains an important reference for the understanding of the tensions between legality and justice, as well as for the debate on the responsibility of rulers and they way apply the law. The study concludes that the intersection between literature and law not only enriches the theoretical field but also contributes to the improvement of society through a humanistic and critical perspective. This Sophoclean tragedy illustrates the dangers of normative inflexibility and proposes a reflection on the need to balance human laws with universal ethical values. Finally, this research points to the importance of classical literature for the development of legal thought and for the formation of a broader and more humanistic vision of justice.
