"we the people of the United States": o debate constitucional de 1787-1789 e a influência antifederalista na constituição dos EUA

Abstract

Esta pesquisa se propôs a realizar uma análise crítica do pensamento Antifederalista e sua relevância no debate ocorrido para a ratificação da Constituição americana, visando compreender disputas políticas entre os defensores dos “Federalismos” nos anos posteriores à Independência, entre 1776 e 1789. Encontra-se, nesse debate, dois lados - os “Federalistas” e os “Antifederalistas”. Apesar do esquecimento dos Antifederalistas, comparativamente à importância dada aos Federalistas e sua vitória no debate constitucional, é importante destacar a influência dos “Outros Fundadores” na elaboração das fontes. Ainda que os Antifederalistas não sejam um grupo homogêneo, esses possuem seu alicerce na defesa da República em menor escala (legislaturas estaduais), das liberdades locais e individuais e na harmonia entre os novos estados independentes. Em contrapartida, os Federalistas apresentavam um projeto de centralização que, segundo a crítica Antifederalista, poderia levar a América recém liberta a uma possível nova tirania. Desse modo, neste estudo foi retomado o pensamento dos que foram outrora destacados como inimigos da nação e rotulados como oposição aos “vencedores” e à nova Constituição, sem qualquer proposta. Para isso, serão consultadas fontes daquele período histórico, principalmente os Antifederalist papers, a Constituição Americana e a Bill of Rights. A partir da pesquisa das fontes selecionadas é esperado acrescentar ao debate da Constituição americana, a corrente Antifederalista e possibilitar novas leituras e interpretações sobre o período.

This research proposes to carry out a critical analysis of the Antifederalist thought and its relevance in the debate that took place at the Constitutional Convention, targeting the political disputes between the defenders of “Federalisms” in the years after Independence, between 1776 and 1789. In this debate two sides can be found - the “Federalists” and the “Antifederalists”. Despite the neglect of the Antifederalists in comparison to the importance given to the Federalists and their victory in the constitutional debate, it is extremely important to highlight the influence of the “Other Founders” into making the primary sources. Although the Antifederalists are not a homogeneous group, they have their foundation in the defense of a Republic of smaller scale, represented by the states legislatures, on local and individual liberties and by the common sense between the new independent states. On the other hand, the Federalists supported a consolidation project that, according to the Antifederalist critic, could lead the newly freed America to a possible tyranny. Thus, this research intends to redeem the ideas of those who were once shown as enemies of the nation and labeled as opposition to the “winners” and the new Constitution, without any proposal. For this, sources from that historical period will be consulted, mainly the “Antifederalist papers”, the American Constitution and the “Bill of Rights”. From the research of the selected sources, it is expected to add the Antifederalist beliefs to the debate of the American Constitution and allow new readings and interpretations of the period.
