Mulheres vítimas de violência doméstica acusadas pela justiça: quando não é legítimo se defender

Abstract

O presente trabalho busca analisar como o ordenamento jurídico compreende e julga a mulher vítima de violência doméstica que se torna ofensora na tentativa de salvar a própria vida, observando ainda, como o instituto da legítima defesa se apresenta enquanto tese de defesa. Como base teórica recorremos a criminologia feminista e teorias feministas do direito. Por meio de uma pesquisa de levantamento bibliográfico, será mapeado o estado da arte de pesquisas e publicações acerca da transposição da mulher vítima de violência à homicida conjugal e os desafios da defesa de tais mulheres.

This paper seeks to analyze how the legal system understands and judges women, victims of domestic violence that become offenders in order to save their own life, also, how self-defense works as a defense thesis. As a theoretical bases we use the feminist criminology and others feminist theories of law. Through a bibliographic survey, the state of the art of research and publications on the transposition of women victims of violence to marital homicide and the challenges of defending such women will be mapped.
