Legislação promulgada no Estado de São Paulo sobre convivência no espaço escolar (2009 – 2020): virtudes e limites

Resumo
O objetivo desta pesquisa é analisar os dispositivos legais promulgados pela Secretaria da Educação do Estado de São Paulo no período de 2009 a 2020 sobre convivência sadia e segura nas escolas paulistas, apontando as virtudes e limites de tais orientações para alcançar o respectivo objetivo. Trata-se de pesquisa documental de abordagem qualitativa. Os documentos fontes são os seguintes: 05 Leis Federais, consideramos essas leis federais porque a legislação estadual, a qual analisamos, é signatária das mesmas, 06 Resoluções Estaduais; 01 Instrução; 1 Plano Nacional; e 02 Manuais. A extração e organização dos dados foram operacionalizadas por meio de recursos da Análise de Conteúdo. Em diferentes etapas da pesquisa autores como: Abramovay (2005); Bourdieu (2010); Charlot (2002); Delors (2010); Freire (1975); Michaud (1989) dentre outros contribuíram analiticamente. Os pesquisadores que compuseram as fontes da revisão bibliográfica também deram contribuições de caráter descritivo e analítico. No que diz respeito aos resultados estruturais, esta pesquisa evidenciou, positivamente, a evolução da concepção sobre convivência em espaço escolar que atingiu no documento CONVIVA, e nas respectivas resoluções, avanço significativo sobre a concepção do convívio social na escola, bem como nas tratativas em relação aos alunos. No entanto, negativamente, esse Programa no que se refere ao profissional, POC, que representará a função precípua de promover a convivência sadia e segura juntamente com a objetivação de práticas para isso tem limitações. Suas virtudes ascenderam-se quando comparado com os outros documentos que fazem parte do Programa de Proteção Escolar, aqui analisados, nos quais os alunos são o centro da punição, da responsabilidade da produção da convivência sadia e segura na escola. E são, unicamente eles, os responsáveis pelo sucesso e pelo fracasso da convivência em espaço escolar.
The objective of this research is to analyze the legal provisions promulgated by the São Paulo State Department of Education from 2009 to 2020 on the production of healthy and safe coexistence in São Paulo schools, pointing out the virtues and limits of such guidelines to achieve the goal of same. This is documentary research with a qualitative approach. The source documents are as follows: 05 Federal Laws (these federal laws were considered because the state law, which we are going to deal with, is a signatory to them); 06 State Resolutions; 01 Instructions; 1 National Plan; and 02 Manuals. The extraction and organization of the data will be operationalized through Content Analysis resources. In different stages of the research authors such as: Abramovay (2005); Bourdieu (2010); Charlot (2002); Delors (2010); Freire (1975); Michaud (1989) will bring analytical contributions. The researchers who will compose the sources of the bibliographic review will also make contributions of a descriptive and analytical character. With regard to structural results, this research positively evidenced the evolution of the concept of coexistence in the school space that reached in the CONVIVA document, and in the respective resolutions, a significant advance in the concept of social interaction at school, as well as in the dealings in relation to students. However, negatively, this Program, with regard to the professional, POC, which will represent the main function of promoting healthy and safe coexistence together with the objectification of practices for this, has limitations. Its virtues rose when compared with the other documents that are part of the School Protection Program, analyzed here, in which students are the center of punishment, the responsibility of producing healthy and safe coexistence at school. And they are the only ones responsible for the success and failure of coexistence in a school space.
