Resumo
O presente trabalho tem como objeto de pesquisa a questão da efetividade das medidas
protetivas de urgência previstas na Lei nº 11.340/06 durante a pandemia do COVID-19, a
partir do considerável aumento da violência contra a mulher nesse período, bem como seus
possíveis reflexos nas políticas públicas dos órgãos de enfrentamento do Município de São
Paulo. O objetivo da presente pesquisa é analisar os possíveis impactos das medidas de
prevenção ao novo coronavírus, a exemplo do isolamento social, na esfera criminal e,
consequentemente, na limitação da produção de efeitos jurídico-penais das medidas
protetivas de urgência já instauradas, levando em consideração o tipo penal de
descumprimento e as ações estatais de assistência à mulher em situação de violência
doméstica. A fim de alavancar o estudo, será efetuado o levantamento de dados por meio
das técnicas de pesquisa bibliográfica, jurisprudencial e estatística, com enfoque em textos
legislativos, materiais doutrinários e pontuais estudos de caso, sendo abordados
majoritariamente pelos métodos histórico, dogmático-jurídico, empírico e indutivo.
The present work has as its research object the question of the effectiveness of the urgent protective measures provided for in Law nº 11.340/06 during the COVID-19 pandemic, from the considerable increase in violence against women in this period, as well as their possible reflections on the public policies of the coping bodies in the Municipality of São Paulo. The objective of the present research is to analyze the possible impacts of preventive measures against the new coronavirus, such as social isolation, in the criminal sphere and, consequently, in limiting the production of legal and criminal effects of urgent protective measures already in place, taking into account consideration of the criminal type of non-compliance and state actions to assist women in situations of domestic violence. In order to leverage the study, data collection will be carried out through bibliographic, jurisprudential and statistical research techniques, focusing on legislative texts, doctrinal materials and specific case studies, being approached mostly by historical, dogmatic-legal, empirical and inductive.
