Resumo
O presente estudo trata da modulação temporal dos efeitos no controlo de constitucionalidade, especificamente sobre sua aplicação pelo Supremo Tribunal Federal. Iniciamos com a abordagem sobre o vício da inconstitucionalidade e a sanção a ele cominada, discorrendo sobre a supremacia da Constituição, a nulidade e anulabilidade do ato inconstitucional, bem como, sobre a aplicação da tese da anulabilidade pelo Supremo Tribunal Federal antes de sua previsão legal no ordenamento jurídico brasileiro. Os artigos 27 e 11, das Leis 9.868/99 e 9.882/99, respectivamente, foram objeto de capítulo específico, com abordagem da modulação no ordenamento jurídico brasileiro, e a constitucionalidade formal e material destes dispositivos. Em outro capítulo apreciamos os julgados do Supremo Tribunal Federal em que o instituto em testilha foi discutido. Visamos à aplicação da modulação de forma a garantir a supremacia da Constituição, e, outrossim, propusemos limites à sua aplicação
This present study addresses the temporal modulation effects in the control of constitutionality, specifically on their application by the Federal Supreme Court. We start with the approach to the unconstitutional vice and the sanction applied to it, discoursing about the supremacy of the Constitution, the nullity and annulment of the unconstitutional act, as well as, on the application of the theory of nullity by the Federal Supreme Court before its legal prevision in the Brazilian legal system. The articles 27 and 11 of Law 9.868/99 and 9.882/99, respectively, were the subject of specific chapter, with the approach about the modulation in the Brazilian legal system, and the formal and material constitutionality of these provisions. In another chapter we appreciate the decisions of the Federal Supreme Court in which the institute in case was discussed. We aim to apply the modulation of form to ensure the supremacy of the Constitution, and, also, we proposed limits to its application
