Na efetivação do direito ao patrimônio cultural devem ser desenvolvidas e implantadas propostas de gestão dos bens culturais, pois o patrimônio cultural edificado é resguardado como direito fundamental. O valor conferido pela sociedade ao bem edificado faz com que seja considerado pertencente ao patrimônio cultural. O patrimônio cultural pertence à cidade multifacetada e é elemento urbano que sustenta a memória. Nesse sentido, com fundamento nos marcos regulatórios, questiona-se a efetividade das políticas públicas municipais de tutela do patrimônio cultural edificado. A presente pesquisa tem por objetivo geral analisar o fundamento normativo das políticas públicas de proteção do patrimônio cultural edificado do município de Araxá, localizado na região do Alto Paranaíba, no Estado de Minas Gerais. Como objetivos específicos tem-se a análise da inserção da proteção do patrimônio cultural no contexto socioambiental urbano; a identificação de aspectos das políticas públicas municipais de proteção do patrimônio cultural edificado; o cotejo das normas jurídicas municipais de tutela do patrimônio cultural edificado com as normas constitucionais e infraconstitucionais e a percepção do estado dos bens edificados e tombados situados na zona urbana do município de Araxá quanto a sua adequação às disposições normativas protetivas vigentes. A pesquisa fundamenta-se na revisão de literatura, sendo de natureza qualitativa, por meio da comparação da legislação municipal à legislação estadual, federal e normas constitucionais. Compreende a análise de normas jurídicas do município de Araxá e ampara-se também na análise documental e das informações contidas em bancos de dados de entidades estadual e municipal de atuação cultural. A pesquisa é relevante considerando que o patrimônio cultural edificado, além de promover a efetivação do direito à memória, contribui para o bem-estar socioambiental. Como resultados esperados, pretende-se identificar a relação da tutela normativa municipal do patrimônio cultural edificado do município de Araxá com a tutela normativa geral vigente.

In order to realize the cultural haritage rights it must be developted and settled down management proposals of cultural goods, once being built haritage understood as a fundamental right. The value given by society to built goods is what makes it cultural haritage. The cultural haritage belongs to multifaceted urban centre and it is an urban point which sustains memory. Thus, considering legal rules, comes up some questions about effectiveness of the local built haritage public policy.This research aims to analyse normative basis of the built haritage public policy applied by Araxá county, located at Alto Paranaíba, Estate of Minas Gerais. As especific objectives, the purposes are analyzing the built haritage protection in enviromenmtal and social context; identifying aspects of the local built haritage public policy; comparing local legal rules with constitucionals and non-constitucionals rules and perceiving the built haritage appearance located at the urban site of Araxá county, considering how suitable they are to the legal rules. The research is supported by the theoretical methology, being a qualitative research, by comparing local legal rules with regional and federal rules, as well as constitutional rules. Additionally, requires the identification of Araxá county legal rules that specifically protect built haritage, besides being based on information from the databases belonging to the local cultural institutions. The research is relevant once built haritage, besides promoting the effectiveness of the right to memory, contributes to social-environmental well-being. As expected results, it aims identifying the relationship between local protection by the legal rules of Araxá county built haritage and the general legal protection.
