Diante da inércia do Estado na implementação de políticas públicas para a concretização dos direitos sociais previstos na Constituição Federal de 1988, a busca pela tutela judicial para a proteção e efetivação desses direitos aumentou, tornando o Poder Judiciário um espaço de deliberação política. Nesse contexto, o presente trabalho tem como objetivo compreender como a litigância estratégica pode ser um instrumento de efetivo acesso à justiça, destacando o impacto desta no acesso à justiça e na proteção dos direitos sociais, em especial o direito à educação, sendo ressaltado o Poder Judiciário como um agente de transformação social. Também se demonstra como a litigância estratégica, ao influenciar a criação de precedentes, pode assegurar a efetivação de direitos sociais, bem como a relação desta com a participação ativa da sociedade civil no processo decisório judicial. Para isso, a metodologia adotada é de natureza qualitativa, fundamentada na revisão bibliográfica de dissertações, livros e, principalmente, artigos científicos que abordam sobre a temática. Ademais, com finalidade exemplificativa, analisa-se, de modo breve, a ADI 5537 e o RE 888.815/RS, para evidenciar a ferramenta estratégica que o instituto processual do amicus curiae pode ser na solução de litígios.
Abstract (english)
In the face of state inertia in implementing public policies to realize the social rights provided for in the 1988 Federal Constitution, the search for judicial protection to protect and enforce these rights has increased, making the Judiciary a space for political deliberation. In this context, this paper aims to understand how strategic litigation can be an instrument for effective access to justice, highlighting its impact on access to justice and the protection of social rights, especially the right to education, emphasizing the Judiciary as an agent of social transformation. It also demonstrates how strategic litigation, by influencing the creation of precedents, can ensure the enforcement of social rights, as well as its relationship with the active participation of civil society in the judicial decision-making process. To this end, the methodology adopted is of a qualitative nature, based on the bibliographic review of dissertations, books and, mainly, scientific articles that address the subject. Furthermore, for illustrative purposes, ADI 5537 and RE 888.815/RS are briefly analyzed to highlight the strategic tool that the amicus curiae procedural institute can be in resolving disputes.
