Procedimento para o Reconhecimento de Pessoas: Orientação do STJ No HC 598.886/SC e Interpretação no TJSP

Abstract

No presente trabalho se discute a respeito da relevância das formalidades determinadas pelos artigos 226 e 228, do Código de Processo Penal para o reconhecimento de pessoas. Nesse sentido, a 6ª Turma do Superior Tribunal de Justiça, ao julgar o Habeas Corpus nº 598.886/SC, firmou entendimento de que o procedimento previsto no artigo em debate não deveria ser mera recomendação legal, mas imperativo. O objetivo específico do artigo é investigar se o Tribunal de Justiça do Estado de São Paulo aderiu à interpretação proposta pela Corte Superior. De maneira geral, busca-se perceber a relevância das formalidades impostas pelo CPP para o reconhecimento de pessoas. Para tanto, realizou-se pesquisa empírica qualitativa, com análise das decisões. A pesquisa se mostra relevante ao demonstrar, em específico quanto às formalidades do artigo 226 do CPP, o grau de adesão da Corte Paulista à decisão do Tribunal responsável pela unificação da interpretação da lei federal. De forma mais ampla, o respeito que se confere à ritualística processual e às formalidades processuais que visam, na lógica de um processo penal acusatório, o resguardo do direito de defesa.

This work discusses the relevance of the formalities determined by articles 226 and 228 of the Criminal Procedure Code for the recognition of persons. In this sense, the 6th Panel of the Superior Court of Justice, when judging Habeas Corpus nº 598.886/SC, established the understanding that the procedure provided for in the article under debate should not be just a legal recommendation, but imperative. The specific objective of the article is to investigate whether the Court of Justice of the State of São Paulo adhered to the interpretation proposed by the Superior Court. In general, we seek to understand the relevance of the formalities imposed by the CPP for the recognition of people. To this end, qualitative empirical research was carried out, with analysis of decisions. The research is relevant in demonstrating, specifically regarding the formalities of article 226 of the CPP, the degree of adherence of the São Paulo Court to the decision of the Court responsible for unifying the interpretation of federal law. More broadly, the respect given to procedural rituals and procedural formalities that aim, in the logic of an accusatory criminal process, to protect the right of defense.
