Resumo

This monograph aims to understand and analyze the impacts of Law 13,467/2017 in the context of the Labor Process after the modification of the criteria for granting the benefits of free justice and the rules regarding the payment of legal fees. The deductive method analyzes the concept of access to justice and free justice, especially from the perspective of the Labor Process. Therefore, it will be used the bibliographic revision, especially the works of Mauro Cappeletti and Bryant Garth and Kazuo Watanabe, which are fundamental for the study of the principle of access to justice. It also intends to discuss the specificities involving the gratuitousness of justice in labor legislation. After, analyze, individually, the arts. 790-B, caput and §4º; 791-A, § 4º; and 844, §2º, of the CLT, which deal with the changes implemented by Law 13,467/2017 regarding the criteria for granting the benefits of free justice and the succumbing of the individual beneficiary of it. Thus, an analysis of the Right Action of Unconstitutionality n. 5677 is made, discussing whether the implemented changes have support in the Federal Constitution. Therefore, the theoretical analysis, together with the examination of the current legislation, shows that the Labour Reform was responsible for substantially limiting access to Labour Justice, in so far as the new criteria for granting justice free of charge and the new rules in the event of the recipient’s succumbing impose disproportionate burdens on the unsuitable party, thus being able to speak, in the anomalous phenomenon of free justice onerous in the labor process.
A presente monografia pretende compreender e analisar os impactos da Lei nº 13.467/2017 no âmbito do Processo do Trabalho após a modificação dos critérios para a concessão dos benefícios da justiça gratuita e das regras relativas ao pagamento dos honorários advocatícios e periciais de sucumbência. Pelo método dedutivo, analisa-se o conceito de acesso à justiça e de justiça gratuita, sobretudo sob a ótica Processo do Trabalho. Para tanto, o presente trabalho se valerá da revisão bibliográfica, mormente das obras de Mauro Cappeletti e Bryant Garth e a de Kazuo Watanabe, fundamentais para a compreensão do princípio do acesso à justiça e sua evolução. Pretende, também, discorrer acerca das especificidades envolvendo a gratuidade da justiça na legislação trabalhista. Após, analisa, individualmente, os arts. 790-B, caput e §4º; 791-A, § 4º; e 844, §2º, da CLT, que versam acerca das mudanças implementadas pela Lei nº 13.467/2017 no que se refere aos critérios de concessão dos benefícios da justiça gratuita e a sucumbência do indivíduo beneficiário desta. Ao final, faz-se uma análise da Ação Direita de Inconstitucionalidade n. 5677, discutindo-se se as alterações implementadas possuem amparo na Constituição Federal. Por conseguinte, pela análise teórica, conjuntamente ao exame da legislação atual, constata-se que a Reforma Trabalhista foi responsável por limitar substancialmente o acesso à Justiça do Trabalho, na medida em que os novos critérios para a concessão à justiça gratuita e as novas regras no caso de sucumbência do beneficiário desta impõem ônus desproporcionais à parte hipossuficiente, podendo-se falar, assim, no anômalo fenômeno da justiça gratuita onerosa no processo trabalhista.
